Will be very difficult to do anything legally...
1. it must be proven he has it.
2. it must be proven that he was aware of his illness when she agreed to consensual sex with him.
3. it must be proven that she was not aware he had it when she agreed to consensual sex with him.
The fact pattern I have to work with right now is as follows:
- Woman has herpes
- Woman is promiscuous...as in having sex with at least one person (the ex bf) while not in an exclusive relationship with him
For all i know, she gave it to him.
1. it must be proven he has it.
2. it must be proven that he was aware of his illness when she agreed to consensual sex with him.
3. it must be proven that she was not aware he had it when she agreed to consensual sex with him.

The answer is in bold... If her ex boyfriend has not had sex with the other girl yet, then she still has a chance to prove it through process of elimination...
Since your GF's friend has never come in contact with the girl her ex cheated on her with... and if the girl he cheated with has it... means she's the source of the problem between your GF's Friend and her ex... If he has had sex again with her after being with your GF's Friend then it will be impossible to find out...
Legally... Can't do nothing about it... I can hear the questions the lawyers will be asking already...

so pretty much shes fucked for life....thts sad i feel bad for the chick. by using the test results from before and after and hes the only guy shes had sex with its pretty safe to say hes the one who gave it to her. the fact tht pisses me off is that this douche bag cant even man up to it and be there for her. Im an ass but even id be there for someone who needed emotional support. hes pretty much completely cut her off and wont even open the door or pick up her calls. from what i understand this guy could really care less and he prolly wont take the precautions to protect himself and the girls he'll sleep in the future.

I get cold sores on my mouth since I was a baby.
That's the only place I get them, but I can't stand when they break out.
It's really not a problem anymore, now that I know the signs of one coming.
If I feel a slight itching/tingling in my lip, I pop a pill.
Then for the next 2 days or so, I don't drink caffeine, alcohol, smoke anything, eat fried foods or chocolate, and I get plenty of rest.
I very rarely get a flare up anymore.
If I do get one, I just take my pills and follow these guidelines and it's a 100x better than just letting it break out like normal.
But basically, I've stopped breaking out all together just by being smart about it.
Knowing when it's coming and taking appropriate action is key.
And as far as I know, I've never passed it on to any of my exes.
I've read that a very high percentage of people carry the virus (maybe even 2/3) but only 1/3 show signs of it.
So some people can be "carriers" and not ever break out.
At least that's what I thought I read a few years ago.
Basically, herpes is not the end of her life
I just hope people don't find out about it, because some people are immature and cruel.

What the girl would have us believe is that her ex-bf slept with a broad once and contracted herpes, then she slept with him one last time afterward and then got herpes from him. I just don't buy it.
Herpes is of course contagious via sex, however, it's not like you have sex once with someone and BAM...you automatically have herpes, then very soon after display the symptoms.
A FAR more likely scenario is that one of them came into the relationship already having it and then over the course of the relationship, gave it to the other person. Now they are just both showing symptoms. (Or...that one of them cheated during the relationship and then had sex with the other many times after)
Not to encourage anyone to have unprotected sex and be promiscuous, but STDs are what is called "rolling the dice"...it's not a deal where he fucks one broad, then another and it jumps to two new people automatically.

The biggest problem with what I have read thus far on page 1... is that there is such a thing as a subclinical infection with the herpes virus... it basically hides until the person with it gets too sick or stressed then it shows up... this is the reason that a person can contract the virus any number of relationships back and then it becomes active...bad deal...

I have also seen a good percentage of male patients with herpes lessions on the base of the penis...which means a condom would not have helped even if they were wearing one...this speaks to the place you see most vaginal herpes infections...the labia minora or just at the introitis...
