Tint ticket question
Hi acuraziners !
got pinged for a tint ticket here in NYS
I purchased my vehicle =that came with rear tinted windows pre-installed that are in violation (i'll admit that). Under VTL 0375 12A4 :
(4) the rear window of which is composed of, covered by or treated
with any material which has a light transmittance of less than seventy percent. A rear window may have a light transmittance of less than seventy percent if the vehicle is equipped with side mirrors on both
sides of the vehicle so adjusted that the driver thereof shall have a
clear and full view of the road and condition of traffic behind such
vehicle.
My vehicle has fully operational side mirrors and I have a clear view of my rear surroundings.
I intend to fully be compliant with this issue, and have received quotes to rectify this problem from original dealer. I hope to have this ticket dismissed pending submission of corrective procedure to the court.
will this be enough to the prosecutor ?
(i did get a quote of $90 to undo/redo tints, so i'm hoping the fine is less than that... if not, i'm not sure if i'm gonna fight it)
if i choose to fight it .... the ticket/citation merely stated rear side windows tinted/not transparent
but there was no officially stated percentage on the ticket itself
what say ye trusty forum members ?
and thanks for your input

pay to take off tint,
pay fine for ticket.
done.
Not sure why ticket would be dismissed, it's prime revenue for the city/state. In CA it's a fix-it ticket. Are you saying in NY it's a moving violation??

fix-its in CA are like..25-50 bucks.
So you're hoping just to get what trivial fee it is dismissed?
We're trying to understand what exactly you're trying to achieve so we can help you. minimize financial loss?

i'm pretty much hoping for minimum financial loss
does the fact that the officer didnt specify the tint percentage, and didn't use the device matter ?
(the rear side windows are fully tinted....came that way from dealer/previous owner, but it'll fall on me to rectify it)
i'd prefer to get them on the technicality (that the officer didn't test/indicate tint level on the citation), and pay no fine/court costs

--have the dealer who sold you the vehicle (hopefully there was a dealer) take off the tint and send a letter to prosecutor saying it was sold that way and they have remedied the problem. Don't fight it, you won't win. You'll need proof the tint is off from whomever takes it off.

One of my buddies got a fix-it ticket for illegal tint on his white GS350. He found another white GS350 without tint and put his plates on it then took pictures of it with a time/date stamp, printed it out, brought it to court & the ticket was dismissed.

Pretty ballsy move, so I wouldn't recommend trying it.... but just wanted to share that story.

I've heard of finding a picture on the internet... but never heard of swapping plates...That's too risky, he would have been beaten out here if he did that type of shit..

I got my 3 tints tix in the last 3 years.
Just paid $70-$80 and be done with it. Not fixing it because it will end up costing more in $ and time to remove/re-tint
I just got tints for the new car too. If i get pulled over, i will consider it to be my donation for the under privilaged in the great state of California.
