but, my name is Jeremy, and I thought it was hilarious! Actually, it was from a guy over on the S2000 forum I'm on...saw it and laughed so hard I knew I had to have it too. 007, we're on the same page!

The only difference between this and a regular accident is the owner of the car could sue dealer for negligence.
As far as the car, dealer should just let the insurance company handled it and get a appraisal for the 2 years old car.
They usually look at similar cars on the market, if everyone is selling their car at $40k, then the owner will get $40k and nothing more. Sucks but that is just how it is.
Now if the owner wants to sue the dealership and the former employee, that is a different issue.
Dealer should but DOES NOT have to offer a brand new car to replace a 2 years old car.
What they can offer is use the $40k (or whatever the payout is from the insurance company) as a down payment and offer some other incentives and let the owner finance the remaining amount.
Even if the owner uses his own insurance, the end result is the same. you get market value for your car.

Gap saved my azz on my ep3...was upside down on the trade before it so $300 in GAP ate up $6K in negative equity when I had the misfortune of totalling the car.

Last week, we told you about the saga of Delaware couple Debbie and John Hooper, who were engaged in a battle with First State Chevrolet over their wrecked 2012 Camaro ZL1. The car was sent to the dealer for a warrantied paint repair, but was wrecked by a joyriding employee that snuck in on a weekend to go for a spin.
First State claimed that as the employee shouldn't have been in the car in the first place, it wasn't liable for the crashed ZL1, although it did try to make things right with the Hoopers by offering them a car with more mileage, modifications, options they didn't want and a rather questionable provenance. This was turned down. The Hoopers wanted a new ZL1 for their troubles.
Now, thanks to a little cooperation from General Motors and Berger Chevrolet, in Grand Rapids, MI, a 2013 Camaro ZL1 is being sent to First State. According to a post on the Camaro5 forums, John Hooper said, "I understand that it will be about two weeks before the insurance check is cut, the old car is paid off, the new car arrives, and a new purchase contract will be signed by my wife and I for the purchase of our new ZL1." Emphasis is his.
There aren't many other specifics on the forums, so we can't say whether it's the dealer's insurance or the Hooper's insurance that are picking up the tab for the wrecked Camaro. As for the newer Camaro, it seems like the Hoopers are being treated like any other purchaser rather than getting special treatment after what they've been through. Whether that's right or not, we'll let you decide. What is clear is that the Hoopers are getting what they wanted - a new ZL1. As car people, we should simply be happy about that.

There'll likely be a bit more information once they sign on the dotted line and are driving the new car. They won't want to let Chevy off the hook in social media until it's done. Good call on GM's part...the negative press that they would allow a dealership to leave the customer high and dry like that will hurt sales a lot more than a $10K loss on the totaled car, plus, I'm sure they're starting the loan over from month zero.

I'm glad this turned out well for the Hoopers. I think they were owed a car that would have been about the same monetarily. Thedealer tried to screw them, so GM stepped in.

6. We have apologized to many of the employees at First State for the actions taken by many of the people who have been infuriated by this whole story and have called First State to voice their opinions. Anyone who thinks the dealership has not been affected by all of this must have his head in the sand.
7. We want to thank everyone for their support. We never expected this to take on a whole life of its own. A special thanks goes out to the suppliers who have so graciously stepped up to provide parts at their own expense to help ease the heartache we have experienced in this ordeal.
8. I am not the biggest tech guy out there, and I have never made it a practice to post on forums, don't have a Facebook page, etc. But I do plan to stick around on this forum, and I hope to meet many of you in person at various events.
9. When the situation is resolved, I will post photos of the new car. I understand that it will be about two weeks before the insurance check is cut, the old car is paid off, the new car arrives, and a new purchase contract will be signed by my wife and I for the PURCHASE of our new ZL1.
