Pathetic! Benz dealer in NJ sells man in CA the WRONG CAR (wrong Vin).

Scammed by Mercedes
I'm still trying to figure out exactly how Mercedes scammed me out of the Active Ventilated Seats on my 2003 CL55. Does anyone know what this Accessory Code listed on my window sticker means:

103 DCAG Pre-Series Factory Code

I bought the car in NJ and I'm in CA so I had to rely on the sticker the dealer faxed me. They scammed me by faxing me the window sticker from another car (which I didn't catch at the time) that didn't have this code on it and that listed the Active Ventilated Seats. It was a computer printout of the sticker since they claimed that the prep guys had lost the original sticker. But when I requested a copy of the sticker for my VIN number it had this code and it doesn't list the Ventilated Seats either. Maybe this code means that there were some early cars that were configured differently. Does anyone know?

Any help would be appreciated.

Mark

(This is back in May of 2003). He has since filed a lawsuit but the dealer will NOT TAKE THE CAR BACK. They sold him not a demo, but a PRE-PRODUCTION BENZ! Pathetic! It is the wrong car.

Has he legally took delivery of "His" car since the VIN is not the one he signed the papers for?

Sounds to me like he got scammed. Of course the dealer will not take the car back, the car is not in question but the accessory, no? Whatever VIN is on the title is the VIN that the title holder owns to whatever car is attached to that VIN....period. My 2 cents.

1st off

he received two differnt vin numbers....

he received one set of vin numbers when he placed a deposit on the car and another vin number on the actual car he received....thus he never received the car he actually put a depoit down on i.e. the 1st vin number he received

just pathetic IMO...also, the dealership never disclosed that it was a preproduction benz to him at any point during or even after the sale...sad

btw, benz people w/the 7spd tranny are having quite a bit of problems....there have been quite a few folks who have already had their 7G tranny replaced ALREADY....yup the entire tranny replaced...hmmm sounds familiar doesnt it

Similar thing happened to my brother a few years ago. He bought a 2003 BMW 325i and waited like a month for the car to finally arrive at the dealership. So we went over there to pick it up and the first thing we noticed is that the car had heated seats even though we never paid for them. So the salesman just says it's part of some package we purchased, whatever. We take the car home and notice that the VIN on the car does not match the VIN they had originally given us when we first ordered the car. It turns out they gave us the wrong car. Everything was the exact same as we had ordered, except for the heated seats. So they eventually drove the correct car to us and took the other one back. But needless to say, that salesman was fired. He was new and was so eager to complete his first sale that he never bothered to check the VIN before calling us to say our car was ready.

Yeah like $250 or less in plane tickets would have prevented this $70k screwup.

But aside from that the dealership should be making it right for the customer. wtf.

As someone stated, for a LOAN, you have to provide the VIN. No VIN or a diff VIN, no LOAN. This is illegal in all ways, not to mention shows no ETHICS.

I didn’t read the linked story, but I thought it was illegal to OWN or register a pre-production car.
Don’t they all go to the crusher after the initial road tests ???
