Shiiiit my dads good friend pays 1800 a year for registration and 900 a month for insurance on his Bentley. (That he never drives )

I get that he drives more exotic cars than I do but insurance shouldn't be more than 10x the cost unless he's got tickets and accidents all over.

registration here is a gongshow, it's based on age and base value of the car (guessing it's the same for your dad's friend) so the yearly registration fee goes down every year until 7 or 8 years of age when it gets to the minimum and stays there. So the tags for my Jeep are like ~$350ish while the tags for the S and Accord are ~$40 each.

I know a ton of people that register cars in Wisconsin if they can because they have a static registration fee no matter if you bought a Fiesta SE or a Bentley.

I can't catch a f*cking break these days. Work's cut my hours in half since the hospital is now budgeting for a renovation (wish we were state-funded).

Long story short, I was pulling out of my parking spot when an older Mustang sped through the lot and hit my rear bumper. My car was already visibly out of the spot and I have 3 witnesses who can verify that the other driver was speeding. The kid panicked and asked not to get insurance involved and said he'd pay cash. I said that was fine since all I'd need to be 100% again is a re-spray on my rear bumper. Well, lo and behold I text him the quote the next day and he responds with "I'm contacting my insurance". I simply respond with a thumbs up emoji and think to myself that this is going nowhere and I'll just pay it out of pocket and let the kid slide.

Today I get a call from a number I didn't recognize so I didn't answer. I googled the number and found out that it was a local insurance company. It is my understanding that in CA, the vehicle backing out would be at fault under normal circumstances. However, my car was visible, loud as hell, and I have witnesses stating he was speeding when he hit me.

You guys have any tips before I start the process with my insurance company and what you guys would do in my situation? I just want to do my best to avoid getting screwed.

Edit: I called local PD and they said they would only come out if someone was injured. Yes, I understand I shouldn't have let him slide but I felt for the kid and gave him the benefit of doubt.

Edit-Edit: I have a video of the other party admitting fault but didn't get a clear view of his face. Shortly after admitting fault, his friend states "no dude, you're not supposed to admit shit like that here."

All this happens right when I finally have a buyer lined up to give me my full asking price..

you should have known better, unless they gave you $3G in cash up front, never trust the "i will pay you first in cash crap after you get the estimate". been there done that. Now you have too.

CA is a no fault state, unless you have a police report, other wise the decision will be based on the insurance(s) with the information both of you provided.

With that being said, if i recall correctly, cars going straight would always have the right of way at least in CA. So regardless if he could see you or not, i think it will be an uphill for you. (unless he T boned you while you are backing up, that is another story)

There is nothing much you can do other than cooperate with your insurance and chances are your insurance will have to pay for the other guy's damage too.

Also not until recently, i have learned through experience that Insurance company does recongize text messages between the 2 parties as evidence. (so if you could have asked him on the spot to text you a statement that he hit you and he was willing to cover all the damages) you probably would have a better chance.

you drive a brand new car, why wouldn't you want to go through the insurance.

yah but sometimes the CHP would refuse to come out unless someone is injured. By sometimes i mean most of the time.

So pictures, statement, the other driver's info, how you describe the incident and how soon you contact you own insurance whether it is your fault or not will determine if the other driver could make up stories and bite you in the ass later.

I personally would never leave the scene of an accident without a police report, but looks like CA is different.

yup i agree except AZ is not the place i would move to.

Trying to think if there is anything good in CA... pretty hard.

House, gas and everything is more expensive
High in Sales and income tax
Red tapes and idiotic policies to drive business away
everywhere is far away
Public transportation is next to nothing (socal)
Traffic is one of the worst
LAX is probably the worst metropolitan International Airport i have seen.

Honestly, I just gave the kid the benefit of doubt and figured he'd stick to his word. Figured I could try having some faith in people but after this, F that. Plus my rear bumper just needs a respray and some dings taken out.

Yeah, PD didn't want to come out unless someone was injured and pretty much told me good luck. How should I word this to my insurance?

I was on the phone with my insurance and got them to lower my rate again from $260-270ish/month to just under $210/month but I still haven't reported this incident. I'm just weary of how to report it to make sure I give myself the least chance possible of getting screwed.

While on the phone with Geico, I requested quotes for other vehicles as well. 03-04 Cobras range from $85-90/month depending on which year I get and an '08 C6 will be about $66/month for full coverage. Both options are much cheaper than my current $210/month for the 5.0 so at least I know that I have those two cars to fall back on if need be. Even if this counts against me, I can't see my quotes increasing more than $50/month.

I was on the phone with my insurance and got them to lower my rate again from $260-270ish/month to just under $210/month but I still haven't reported this incident. I'm just weary of how to report it to make sure I give myself the least chance possible of getting screwed.

You just tell it as it is. Insurance here knows that police reports are not always available. Normally it is my words against his words unless there are witness but backing out vs. going straight is kinda hard to argue. Again unless he T bones you. If your damage is on your rear bumper, then I think you are out of luck.

Just let your insurance handle it from now on. Just hope the other driver does not make up more BS like his neck hurts and shit.

Just some witnesses who side with you and some fucking cocksucker claiming you were backing out when he accidentally hit you while he was buying flowers for his grandmother? 2 sides to the story and not calling the cops doesn't work in your favor, but it also doesn't work in his. "Not sure who this is or how you got this number but please don't contact me again".

Seems pretty simple to me...it never happened. Simple as that...cost of the bumper respray which you already had coming, and a lesson learned. Stop being nicer than the people you deal with.

Now...easy suggestion, deduct a bumper respray and an extra $200 for the hassle from your asking price and let the new guy deal with getting the car back to perfect while you get your financial legs back under you.

You've lived fast...now live within your means. Having no stress and money in the bank is almost as exhilirating as an 11 second quarter. For you YOLO generation...yes life goes by fast...but it's still really fucking long. When you're 40...have your house and hot wife and kids and THEN get your boosted C6 or C7 or Lambo or whatever.

That's my opinion and advice.

as i said just let your insurance handle it at this point since his insurance is already involved and most likely already heard his side of the story.

you can't put too much time arguing that he was speeding because based on his damage, it is really not that bad.

just learn your lesson and the accident will be gone from your record in 3 years.
