Is it legal for dealership to sell car with hidden rust?

I made my first car purchase a month ago and it went south stupid me i know i got tricked to buying a car then the salesman latter told me the car had frame damage after i had signed the paperwork now im finding so many things that are wrong with the vehicle i learned my life lesson anyways i found hidden rust behind the steering wheel i think its called the steering wheel box and i also found rust behind the seats or at least the frame of the seat that connects it to the bar i was wondering is that legal for dealers to sell a vehicle with hidden rust? would they be able to take it back or am i doomed?

Have you run a VIN check on it either through CarFax or even your insurance company?

Definitely get a Carfax report and work on punctuation along with spelling.

undisclosed damage ill go back to the dealership and see what they say.

It's hard to be taken seriously and get honest answers when it is obvious that you don't care. We aren't asking for perfect sentences but when you put in complete crap, expect complete crap in return.

Stick around and you will notice that it isn't going to be just undying dream on your back, everyone will be annoyed. That being said, there are tons of great people on here with great advice, just put in a little effort and you will get the answers you seek plus hours of entertainment.

1) get a Carfax report - hope it reports something related to your problems
2) go back to dealer with Carfax report
3) be civil
4) if you are not satisfied, see legal assistance

A little bit of surface rust on the seat frame and the dash subframe is totally normal imo:

Waiting for or other lawyers to chime in but I would assume if flood damage or damage was more than a certain % was on the Carfax they would be responsible to disclose it.

If he can prove that they disclosed the rust damage only after he signed....then probably, yes.

I think a lawyer should draft any letter sent to the dealer, and not the OP.

Yes, it is legal in CA.
However, certain conditions require the dealer to disclose them to you-- flood damage, salvage title, etc. Other conditions need not be disclosed if they were not observable the dealer (bad body work hidden underneath carpeting or coating).

Now you need to look through all of the paperwork you signed to see if there was a disclosure of flood damage, salvage title, etc. If there was, you're probably out of luck. If not, someone will need to figure out the cause of the rust and whether there was an obligation to disclose it.

FYI, your state may also have different laws regarding disclosures in the sale of used vehicles than other states.

This assumes that 1) the damage was reported to Carfax and 2) that OP did not see a Carfax report-- although it could have been buried in a mound of paperwork.

carfax and autocheck showed no sign of flood, salvage or lemon, today i went back to the dealer and showed them the areas i was concerned about,They had told me it was normal oxidation i will take pics in the morning and show them to you guys and you be the judge and no they did not disclose that there was rust damage behind the steering wheel my quess is it was hidden and whoever worked on the car didnt do a good job hiding it.

they have another tl type s on the lot i suppose a simple trade cant be done? i also have on contract the dealer guarantees that the car is not a salvage nor lemon buy back there loan manager had explained to me if the dmv issues a salvage title they will buy it back.

Check some of your electrical connections too. You may even see corrosion.

That is not "normal oxidation"-- I've never seen corrosion like that on interior metal components except where the interior was exposed to the elements.

Better find out about flood car disclosure requirements in your state.
A flood car can have regular title rather than salvaged title, too.

Pop one of the seats off. It's only 4 bolts and look at the electrical connections. It's pretty much the lowest interior part of the car.

i live in california so does anybody have any clue what the flood law damage is but the thing is the previous owner was from Minnesota but the car i got was at a local dealership

wouldn't this be considered a disclosed damage? they tried to argue with me saying it was just normal oxidation i went on arguing with there loan manager saying this car was flooded.

Willdogs link had this link for checking if you car was registered in a flooded area last and it is free. Not a guarantee but it's something.

Willdogs link also mentions that even though a car is registered as salvaged, flooded, or totaled in one state, it can be reregistered in anther state with a clean title. To help combat this, as of 2009 insurers and private companies are required to list cars as total losses regardless of what state and that information can be found here (think they charge tho)

My tl-s produced in 2007 so that puts it out of the picture of being a stolen vehicle in terms of those 2 hurricanes.

Best advice is to seek a lawyer's opinion. After the fact, i think you're out of luck. That's why it's always recommended to get an independent shop/mechanic to inspect it before you buy it. Dealers always welcome this and if you pass, after driving it off the lot, the problem becomes yours.

yeah i know i was stupid i just fell in love with the car when i drove it. The dealer says there willing to remove and repaint any outside body rust but im out of luck with the hidden ones.
