Thread is opened because of a complaint from the buyer, RU_JELLY, about the condition in which it was received.

well I hate having to deal with this but heres what happened. I purchased the kit from rush, paid for it through paypal. He shipped it out I believe two days later via usps with insurance for 1500 on it. I was in michigan on vacation when the clutch came and didnt get a chance to look at it until I got home friday at about 2 AM. I opened the kit and was disappointed right off the bat, no packing inside of the box whatsoever just metal on metal and the first thing i see was rust :
Started taking stuff out and there was damage :
The only thing that didnt look damaged was the flywheel :
The kit was described by rush as "brand new", I realize there are going to be a few small scratches from clutchmasters testing it and such.....but this is well beyond that. He opened a claim with usps and he told me to take it into my local office today, I did about an hour ago. I was told they needed the paperwork not just the claim number that he gave me. The supervisor did tell me that in her personal opinion that there was no way that usps was going to honor the insurance claim and that there was "no way in hell" that this was a new clutch that he sent me. I called rush immediately and told him this and thats when things went south. He basically expects me to ship this clutch back to him without being refunded and I am not doing that after all of this happened. I already have 790 dollars tied up into a useless clutch and I'm not about to trust him after sending me this. He claimed that I already had this clutch and switched mine out for his (even though if you look at my post you can see that I have been looking for a new clutch and flywheel for a while and that my OEM clutch is going out) He requested that I post pictures up on here and also a video (for whatever reason?) and that he would refund my money.....here is a video:
If anyone wants to weigh in on this feel free. I have done multiple transactions on here and have a flawless selling status on ebay (justinboyer1983) with a 248 star rating. All I want is my money back, I even told him i'd pay for the return shipping.

If you paid via PayPal call them and open a claim (you have 45 days from the transaction to do so). Tell them about your trip to the post office and how it was sent damaged. Once you win the case (I don't see how you could loose), PayPal will ask you for a tracking number and once it is delivered you will revive your refund.

Like I stated to you several times SEND the clutch kit back to me I'll refund your money ASAP. Stop trying to make look like a bad person. There's no way that thing was rusted. I don't know what you robbed on the pressure plate in the second pic & the box is ripped you can check all my transaction on here I Never had a single complaint. But like I said again return to me & I'll gladly send you your &790

I would recommend something like safe harbor to be a middle man to resolve this.

I was going to purchase this kit from Rush. The deal fell through since he didn't hear from me for a few days, because my phone broke and I had to wait on insurance for a new one. If I remember correctly rush's pictures didn't have any damage like the ones you pictured. I knew it looked like it was bolted on and I even double checked with him to make sure it wasn't used. He confirmed it wasn't. I know clutch masters does that for inspection so I wasn't worried.
He even went the extra mile by sending me a text with a few pictures and video to show the clutch up close to answer a few questions I had.
I don't personally know rush but I know he's been on here awhile and seems like a good guy. By a quick search it, doesn't look like he has had any problems buying and selling parts with other people. This is my opinion I hope it helps.

Yea he was a great guy to deal with up until the point I received a rusted up clutch. He sent me pictures of the clutch also and they all looked great. Bottom line is theres no way I could find a used stage 3 clutchmasters kit, and have it shipped in this short period of time. next to impossible. It's transactions like this that make people not want to purchase things online. I have never had an issue with anyone on this site but I'll be sure to protect myself better next time I make a large purchase.

As long as you didn't "gift" the money, they shouldn't have released the funds to seller until buyer confirmed it was received and they were happy. Normally, the money stay in limbo until both parties agree that everything is as it should be.
Tough situation since buyer won't trust seller to refund once the product leaves his hands and seller won't trust buyer to not just get a refund and keep the clutch.
I think that once shipping is confirmed, the funds go back. I wonder if it's like honda rotors...if it's bare metal and it rains or is super humid, they glaze over with rust immediately. Packaging for shipping was a little lackluster but is any of the cosmetic stuff and the rust you're seeing going to stop it from functioning? Just curious if the rust would just naturally come off and all would be well.

I'll contact him thanks for that. Like I said before tho no way I'm shipping this back first without PayPal being Involved.

Rush has always seemed shady to me. He tries to sell parts for way more than they are worth. He wanted me to pay 2500 for a p2r header that was 1200 new. I know who I believe.

8/9/2012 10:36 PDT - PayPal: Buyer escalated this dispute to a Claim.
8/9/2012 10:36 PDT - Buyer: If you look through the thread that I purchased this in, the item was described as brand new in the box. Upon opening there was no packing to protect it and it had scratches and rust all over it. I contacted him and he insist that he will give me a refund but wants me to ship this back without going through paypal and expects me to trust him with my money until he receives it. I do not trust this guy at all. As soon as I presented the problem with the rust and such to him he took down the pictures that he had posted on the thread which also makes him look very guilty. He claims that I switched the clutch out for another one that I found cheaper which was impossible because this is a rare clutch to find unless you buy it brand new from a store or online store. I even have threads that I started on the same forum stating that my OEM clutch was going out and that I was looking for an upgrade. Here is a link to the thread that he had it posted for sale. https://acurazine.com/forums/showthread.php?t=863560I told him I would pay shipping back but I want the rest of my money back in full. I believe what happened is he had this used clutch or maybe it sat in water, he insured this clutch for 1500 dollars (which is 150 more than it cost brand new) and he is trying to pull insurance fraud with the post office. The post master at my local office told me there is no way that something like this will get approved for the claim and that there is no way this clutch was brand new when shipped.
8/8/2012 07:50 PDT - Buyer: I am requesting full refund as this item was clearly posted as brand new in box, when I received the item it was rusted in multiple areas and had scratches all over it. Seller told me he would refund money If I posted pictures and a video on the original post he made and I did so. Now he expects me to ship it back without getting my refund first. I told hiim I do not trust him doing that because he has already sent me a used or defective item. I have spoken to the moderator of the website also and he says to not send the item back without receiving my refund first
