Craigslist sale gone wrong d:

So I sold my 97 CL on craigslist. And for you bay area people, if you know who Lil B is, that was my client.(yeah the no-flow rapper who has an army of idiots for fans) He made me take 4 hours out of my freaking day to look at the car and drive it around and I even risked myself by following him to a different location to get money for the car. I placed a new tranny and motor in the summer of '12 and also fixed the vtec solenoid a month or so ago. The car drives great and he even said it drove well when we test drove it. I constantly reminded him that if he wasn't comfortable with the car, then we didn't have to make a sale. But he finally made his decision and purchased the car, leaving me to take bart home from concord all the way to Hayward with a wad of cash on me.
I get a call the next day from him saying that he wants a refund because when he started to drive it a check engine light came on. -_- I sold the car perfectly fine and he's saying that he'll give the car back in the same condition as I sold it to him. As far as I'm concerned, whether it's listed or not, all sales on craigslist are final and are conducted with no refunds unless it's stated. But in the time I didn't respond to him, he started harassing me with texts saying i f*cked him over and that he's gonna call the police and make it a legal matter. I've been stressing like crazy and I can't even do my work since it's finals week. We're talking about a guy who holds guns in his music videos sometimes. I could either take the car back and give him his money, not knowing what he did to the car or I can keep the money and see where that goes.. I'm confused on what to do and I'm upset that a craigslist sale went so wrong. I just wanted to sell the car and not have any problems but now I'm afraid he'll do something since he has my pink slip that has my address on it. And maybe not even him, he could like send one of his posse or something to my house. Opinions?

did you have him also sign a written notice/receipt of sale for the vehicle being sold "as is"?

No I dont, but in the disclaimer for craigslist it says, "8. DISCLAIMERS

YOUR ACCESS TO, USE OF AND RELIANCE ON CRAIGSLIST AND CONTENT ACCESSED THROUGH CRAIGSLIST IS ENTIRELY AT YOUR OWN RISK. CRAIGSLIST (INCLUDING, WITHOUT LIMITATION, THE WEBSITES, PROGRAMS, SERVICES, FORUMS AND CONTENT ACCESSED THROUGH THE WEBSITES, PROGRAMS, SERVICES AND FORUMS) IS PROVIDED ON AN "AS IS" OR "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND."
So I'd figure, as should anyone else who purchases on classified ads, that everything is sold as is and once you fork over the cash and sign the papers its your responsibility. I'm just afraid of what could happen to my family or me since he has my address.

a chick tried to pull the same shit.

I sold a car to a "friend"
I told her "if it ever reaches the red, dont drive it!"
I even fixed the leaky water pump for her!
but guess what, she drove it while it was over heating.
warped the heads.

she wanted a refund after a month.
and even had a "homie" call me and ask for a refund. he wasnt very polite.

told them to fuck off.

she signed a bill of sale.

ALWAYS get stuff in writing. too late now, but i'm not sure how much the rules of craiglist have in terms of "in the eyes of the law" type thing.

maybe you need to tell him this disclaimer.

So I gave guy a chance a chance to come get his money but he is ignoring me so I am considering just turning in the transfer slip to the dmv so it's legally in his name.

just turn it in, make it official..

hes not gonna do anything... he probably is on probation, has a criminal record, etc... and if he is smart enough he wouldnt risk all that over a damn car..

but keep in mind.. cragslist rules do not apply to street rules..

and also this rapper has albums and gold chains.. why the hell is he buying a car that is 16 years old..

took the car back like an idiot. Was really taken for a bitch when I knew there was something wrong with the car and I took it back anyways. CEL reads p0335 for a crankshaft position sensor. Anyone know what's happening? It's accompanied by terrible acceleration and sometimes I wont shift unless I let off the gas a little.

You're have got to be trolling us.
All that build up of a story and you end up with the car back without a mention of how it went down or why it went down?

You sell a car, you sign over the title to the person and they sign saying they bought it. Done deal. It's not like a friend borrowing it from you. Make it clear that the sale is final.

Cough it up.

lol there's only one possible name that the B would stand for. But the reason why I took it back was because I just didn't want to deal with any further confrontation. But in all seriousness it was extremely dumb of me to take the car back. Sorry to disappoint guys. But does anyone know the solution for a p0335 code? Do I just gotta install a new CKP. Sounds difficult

Lil B messed up your car and gave it back to you.

No way in hell I would have took it back.

It was Lil B...a big mouth, broke midget. You act like it was 50 cent buying the car.

Yeah, if it was 50...I'd have gone to pick it up and let him keep the money in the first place.

Seriously though, fix the car and resell it, put it in the past. Learn your lesson.

Yeah. Live and learn.

Next time though, make sure you have the buyer sign a bill of sale and statement saying that the sale is final, car being sold as-is, and no refunds. Then send in the transfer of title to the DMV ASAP.

Over the years as I have bought and sold many things on Craigslist and EBay I'm fully convinced some people should just not participate.

I know this is an old thread but I decided to look at Lil B on YouTube and thought he was terrible. It is an old used car so I am wondering how much did you sell the car to him for? I would have at least consulted a lawyer with a free consultation. As for the idiot driving up to your house and blasting you... I seriously doubt it. You could have gone to the news at your local city. Think of it this way. Things happen for a reason. Now you can fix it back up and sell it. One more bit of advice... Meet, make the exchange, sign, and leave. Do not be driving anywhere else. For all you know they could have killed you or made the exchange and then beat you for the cash later. Be smart and think ahead next time. Either way sorry to hear about the issues you had but hope it all works out for you in the end.
