I think it is a question of standing behind your product. They may not have to fix it, but it would hurt their reputation some.

they need to fix it. if i paid for the most expensive 3 series (sans M) im going to want power and working components.

it is 100% an engineering fault and BMW should be held responsible. lowering the engines output and covering up the symptoms isnt how it should be handled. look at what honda did with the 2g tl, which would have otherwise been great cars.

This. It's not a matter of if the should be made to, its a matter of if the want to hurt themselves. It shouldn't be something that government should be telling them to do! Of course when I buy something I want it to work properly. I didn't sue acura when I had 5 trans failures which is a larger safety issue than this nor was aura forced to fix it.

This has nothing to do with BMW hurting themselves. It has to do with BMW acknowledging there is a problem and finding a permanent way to fix it. Believe it or not, unintended de-acceleration can be just as dangerous as unintended acceleration. Imagine you're merging onto a freeway, all of sudden you lose all power and there's a tractor trailer barrelling down on your ass. Sooner or later someone is going to get killed or seriously hurt because of this. There are already many close calls with N54 owners on e90post.com. And before you tell someone to just sell their car, why would the average N54 driver sell when there is no recall and BMW hasn't acknowledged the problem?

Had BMW issued a proper recall for the HPFP issues, I would have bought a 335xi 6spd. The HPFP's high failure rate scared me away from BMW.

The point is is the govt should not be involved in these matters. Especially when the car is under warranty. If you dont like it get rid of it and give the company a black eye with bad reputation. Suing has become the American way

Just because suing is overdone doesn't mean it should never be done. There is a legitimate safety issue at concern here. I think BMW should be sued, not for damages, but for remedy. They should be responsible for fixing the issues they created.

And your logic, that if you don't like it you should sell the car, is flawed. If you bought a toaster and 6 months later found out that, when turned on, it could potentially set itself on fire, would your best proposed solution be to just put it on ebay and move on to another toaster?

It's gonna take an aftermarket company like Walbro or someone to fix this problem. BMW pretty much washed their hands of this as soon as they issued the extended warranty...

I was going to pick up a 2008 335i a couple of months ago, but was overwhelmed; surprisingly I might add, by the stories of HPFP problems that surround this car. Yes, this car is gorgeous inside and out, but it simply isn't worth the headache that comes with ownership. I was further disappointed by news of the N55 having the same HPFP problems, my dream of 335i has been shattered completely. Much like there are companies that provide all metal cooling system components for the e39 vs the plastic OEM ones...

...then again, the failures could be a symptom of deeper flaws within the engine design..

I don't think that will happen. It's just a crime that BMW can't fix the problem.

I too was so close to getting a 335 but, I too have been put off by the f***ing fuel pump problem.

M3 is just a pipedream.

Even though my car has been to the dealer 3 times since June because of HPFP and other issues, I'm still in love with the car and wouldn't want to drive anything else. As long as they give me a BMW loaner, it's just the matter of dropping the car off and picking it up a few days later.

Yeah, I got the car in June. It's been to the dealer twice for HPFP and a soft brake pedal. I was just there today for a third time because of a low coolant warning. They topped it off and sent me on my way. Hopefully it's not a leak.

You obviously have a high tolerance for taking a car to a dealer repeatedly for the same thing. The point is...you shouldn't have to. "Buy a BMW and take to the dealer every month." That's ridiculous by any standard. BMW should make the problem go away. Does anyone on this planet think that BMW can't do it? NO. They just won't do. They choose to repeatedly inconvenience their customers.

There is no doubt that the 335 is a fantastic driving car with many laudable traits. But I would have a hard time dropping that kind of coin on a car that has a persistant problem with no end in sight. The whole situation is a real shame...except for their interior, I love the 3 series.

You never know...if a company is enterprising enough, they'd be R&Ding this issue like yesterday...this is a huge untapped product opportunity. i mean, it's just a goddamn fuel pump, ain't it?!? This still leads me to believe it a symptom of a bigger design flaw.

...and you're right, some of the shoddy engineering BMW puts into their cars is inexcuseable considering the price. I understand having leading-edge tech, but the Germans make it unnecessarily complex. Prime example on a much simpler scale: their cupholders

The M3, my favorite car on the road at the moment, continues to display a strong resale value so the prices haven't quite dwindled like I hoped. Some idiot was selling his 08 M3 for, and I quote, 54K. Needless to say, I don’t have his contact info anymore.<o:p></o:p>

As you can see, I have my eyes dead set on a coupe. My rear seats in my G are never used unless I change my cotton scented fragrance from the pocket behind the driver’s side seat. I refuse to get another Infiniti G unless the next gen looks like a Porsche 911, and looking how unattractive the new M looks, my confidence in Infiniti has tanked.<o:p></o:p>

So, where do I go from here? My conscious says; wait for the M3 prices to drop since that’s exactly the car I want, instead of settling for something I’ll end up regretting. Either way, next year will be interested when I start visiting the stealerships.<o:p></o:p>

Seems like we are living in a parrallel universe. I haven't given up on the Infiniti YET. You are correct about the S5....saw one on a dealer lot yesterday...almost 60K

This is one reason why I'm seriously thinking about the 'Stang 5.0.

Coupe only? If you're willing to look at the sedan, take a look at the 335d. Tons of torque, almost as much as power as the 335i, and none of the HPFP problems.

A friend and I were talking about the 335d. MPGs FTW! He absolutely wanted a coupe though, and preferred a manual, so it was a no go. At least from what I can remember, it was automatic only.

Thanks for suggestion, but I'm not a fan of the 3-Series in a 4-door form.

Yep, the N54, esp. in the 3, has been the topic in BMW forums for quite some time.

It's the reason why I stayed away from the 3 coupe (not interested in the bland 3 sedan) which stinks since I grew up driving BMWs.

Keep in mind guys that the forums make the problem out to be much bigger than it might be.

People don't join forum to talk about how well their fuel pumps work, they join them to complain when they don't work. Not to mention how many of those pump failures are do to misuse. I would bet several of them fail because people put 89 octane in their tank.

I have owned my 335i for a year and a half and I haven't had any signs of a bad fuel pump.
