Sad day for my 4 month old car

I was driving and minding my own business and all of the sudden.....WAM! BAM! The kid crosses the median and right into my car. He said he didn't see me. I wasn't too mad but still quite upset that my new car is now tainted...by an accident! I had to change the tire out to a spare tire so that it wouldn't rub against the side of the car, but at least it was still drivable. The cops said that since the kid admitted it was his fault and the accident wasn't too bad they weren't going to write a report....is that normal?

I could understand them not giving the other driver a ticket... but a report should have been made...

he admits it now but who's to say he won't change his story when the insurance companies get involved. Without evidence (police report, witnesses) it will be your word against his. I don't understand the cops not taking a report. You just better hope the kid is honest.

Man get a report from those lazy azz cops.. My bro is one and i no for a fact tht they dont like wasting there time writting them but for ins purpose's get one

damn man sorry to see this, make sure that after u get ur car repaired u get ur depreciated value from the other kids insurance, if u need more info on it pm me and i can tell u wat i did after my 4 month old 3g type s was rear ended

I'd go to your local accident reporting centre and make a report. It's always good to have backup, sounds like the cops were just being lazy.

Be very glad the damage is where it is though. If the kid had hit you in front, chances are you'd have a much harder time getting the car back to where it was.

If it's not my fault, I definetly, 100% want an accident report. Better in the long run that way.

where I live when ever the cops show up there is always a report.

also considering your car is not driveable (since you had to put the spare tire on, so it did not rub), it needs to be driven to the bodyshop, and you given a rental car (since the spare is limited only to 50 miles or so by design)
btw i have had a car towed from an accident and all it ever did was grace the tire, with a little scruff, but considering the wife drives here car quite a bit for work, any alignment issues would have been magnified, and i did not want to have to fight the insurance for a set of 4 tires, because of it being an AWD (and it was also the other guy's fault too)
let alone we also got a rental car that afternoon too due to the car being undriveable (otherwise they make you drive it till the body shop can get you in, then they will give you a rental)

thanks everybody. The police said they didn't write a report but they did give me a case number. I contacted my insurance company but since it was a weekend I won't be able to do anything until Monday. I do have 2 witnesses, my friend in the car and this other lady behind us who stopped and gave us her phone number.

In the absence of a report, witnesses are your next best thing. However, your friend won't be considered an "independent" witness. It's a good thing you have that lady though.

Sorry about your car man. As far as the report goes, that is def not normal. A report should have been written. The officer had no business telling you that. Ultimately it is the decision of the parties involved (with the exception of serious bodily injury(s) or death) in the accident to decide whether or not they want a crash report written. It sounds like he made you guys minds up for you.

u need to get a report dude,

that happend to my friend lady hit him in the parking lot she said ok she did it, then once insurance got involved she said she didnt do it and my friend had no proof because the cop didnt write a report

I told him to call the station because they should have the log of calls and what not but he never did

just cuz he didnt give you a copy does not mean there wasn't a report..


don't listen to all the other people saying you should have got a report.. in socal, most cops don't give you report, they just tell you to let your insurance company get the report from station. as long as they provide you some type of document with case number its fine.

I agree-a few years ago I was informed by a few Pa state troopers-If the car is driveable and no one was injured they do not write out reports.

btw, its going to be hard to fix that... they will have to cut and weld pieces to it. you better get a really good shop to fix it.. i prefer to bring it to acura.

get the estimate from acura and tell the other party insurance that you want your car to be fixed by acura only.

have the check cut to you directly, go to another place thats good and have them fix it for half the cost. then use the rest of the money to dump into your car.

Even though the kid verbally admits it was his fault, he can later argue differently. A report is a good start to show insurance whose fault it is in writing. The cop was lazy. Sorry about the bad news.

Yea if they gave u a case num then they wrote sumthing down jus make sure that u get it from the precint and read it to make sure its correct. a while ago i was involved in a fender bender and the cop who wrote the report was in a rush to go on vaca that he made me at fault which was wrong so i made them do the report over..

+1 That is a tough area to repair. And yes I would bring it to the Acura Dealer to fix. This was it will be done correctly with original Acura parts. This way if anything goes bad down the road you will be covered and for resale it will show the dealer fixed the car originally.
My sister did that when she got into an accident with her Infiniti G35X. Looked as good as new.

there are shops that do dealership work too you just have to find them

get the estimate from dealer and take your cash elsewhere to repair.

you get more money to pocket that way.

FYI, the police will not right a report unless there is a certain amount of property damage or someone is hurt. If someone goes to the hospital in an ambulance, the police HAS to charge someone and do a report. If this guy that hit you changes the story,to HIS insurance company, then it can drag out, unless you let your insurance fix your car and let them go after his. MY advice, is to go to the hospital, if nothing more than a check up, if you know you are not at fault. You can then let a lawyer handle it if you want to go that route for your suffering.

I have seen this situation many times to know it can be a hassle and delays when no report is taken. Hopefully your situation will go smooth.

I don't know about other states but in Texas if you haven't finished paying off your car, the insurance company will not make the check out to only you. They will make it out to the body shop and you!

um. you are wrong.. for this situation, a report is generated, but not given to anyone besides the police station. a report is only not generated if its a bumper tap or something minor thats under $500.00 ( i believe thats the limit in socal )

usually what is needed to be done is that your insurance company will call the station to get the police report from there on, they will pay to fix your car first and go after the other insurance company.

go through your own insurance company, they will pay you much more if you were to go to the other party because the other party insurance wants to pay you as low as possible to fix the car with a limited amount of shops you can go to.

your own insurance company does not care how much they pay out because they will get it back from the other party insurance so they will not say much about the amount.



take the advice, go to acura dealer, get a qoute, give it to your insurance company and tell them i want a check given to me directly to fix the car. do not talk to the other party insurance!!! they will screw you over

His insurance finally accepted liability after phone tag games for about a week. They are willing to pay for all the damages and get me a rental car. I got an estimate done my insurance company and they said it would be about $4500, that includes replacing the doors, bumpers, mud guards, side moldings, and fix the wheels. The other guy's insurance did an estimate for $2500 to fix everything if it is fixable, otherwise they would replace the parts and pay for the extra parts. I'm gonna go ahead and get it done with his insurance company because it would be easier and they have a lifetime guarantee on it by the shop and his insurance company. Also I read somewhere that you can get extra money to "compensate for the loss of the value of the vehicle" since it now has been in an accident. Have y'all heard about that? Maybe I should try to get it?

Hi,sorry to hear your story.I got the same situation as u re.My advice for you is go to the body shop that acura dealer recommended.Make sure they use the manufacturer parts for your car.Good luck.
