is it broken?

Better question....Why do you want to replace the fork?
even better question; what symptoms is your car displaying that makes you want to change out a part?

if u look @ the black and white picture with the stars around it, seems like its broken, the problem is the ride ins't smooth as much, when i hit bumps it feels as the car goes a little deeper and also when driving over 120KM+ it feels the alignment is off/so without fixing the problem cannot do a aligment

you need to look at where it connects.

its a fork. so two connections at one end, and one on the top end.
what is the top end doing?

is it not connected to anything?
is the pinch bolt broken?

So the alignment only goes off when you over 120km? What about under 120km? Can you see if the top is loose or broken (the strut fork)?

well until 100-120KM steering wheels gets shaky then after 120+KM it feels like drive shaft going to break feeling..

I assume you mean that the steering wheel is shaking at 100-120 km/h (50-60mph)... Did the alignment shop tell you something is broke? By the pictures it looks as though your fork is fine.

Were the pictures taken while car was on the ground or raised?
Have you had your tires balanced?
Have you had new tires mounted? Tire rotation?
I am assuming stock suspension...

You need to take the wheels off to see if the connection from shock to fork is skewed/misaligned.... There should be a lip on the shock that should sit flush with the fork...
