17x8 +44 235/40/17

will this fit w/o rubbing on an 04 TL? thanks.

if it doesnt rub, are there any other issues with the tire size?

It won't rub, but the overall diameter is too small. Your speedo and odo will be off (reading too high than actual speed/distance).

would 235/45/17 be a better option?

Yes, indeed. 235/45 R17 is the original size.

245-45-17 will give a bit softer ride and more rim protection...
