I'm not sure how clear coat can "wear away", especially in that location. Any chance that you or a detailer might have gotten a little too aggressive with a polisher or used the wrong polishing compound? Is it wearing away or peeling? If the latter, and you purchased the car new, then yes, that could be a warranty issue. If you bought the car used, it sounds like that area had been repainted and the clear coat didn't bind correctly.

That area is called the sail panel. The sail panel is a common place for painters to blend the clear into the existing clear, when refinishing the quarter panel or A-pilliar/roof pillar area. I bet there was paint work done on the car, and now it's showing up, and/or it wasn't done right. Even if you owned the car new, it's possible there was a repair at some point. Every once in a awhile a dealer will have to do a small cosmetic repair on a new vehicle to address paint issues, due to factory paint flaws or transportation damage. I've even seen a brand new MDX right off the transport truck with a factory repainted quarter panel.

If it's had any body work done to it, dealer will not honor any claim on it. They will measure the paint thickness, and if it doesn't match factory spec, you are shit out of luck.
