I think the OP's post could be construed as raising two issues that ought to be distinguished:
(1) The Navi software requires a specific DVD, and some model years require different DVDs that are incompatible with other model years. You cannot replace an '05 TL's DVD with an '09 TL's, for example, because they are incompatible. As others have noted, Acura makes this easy for you by coloring the disc label. Your new DVD must have the same color label as your old one. Otherwise it won't work.
(2) With that said, they do update the DVD each year and it's perfectly OK to replace your DVD with a newer one, again as long as the label is the correct color. The more proper way to distinguish the annual updates is by software version number (e.g., my 2004 TL came with 3.30, and I believe they're now on 3.A0, whereas I think TLs with the white-label disc use version 4.xx or some such). But of course the version number is not something many non-aficionados would know. ("3.A0," incidentally, is the hexadecimal notation to indicate version three point ten. They can't use "3.10" because that's less than "3.30.")
The reason I make this longer explanation is that while the people on this forum will understand the point about a 2005 TL needing a different DVD from a 2009 TL, people on eBay or other places on the secondary market may not, and thus it's better to be cautious if you're not buying it from the acuranavi site linked by "quake97" above. The crucial thing is to make sure that you have the ability to return it for a refund should it turn out to have the wrong color label.
