If they don't ask, wouldn't it be their responsibility? I'm sure hundreds of cars are traded in every day that shouldn't have a clean Carfax. One example, a guy I know hit a small deer in his 2009 ZR1, replaced the bumper for 3500 bucks out of pocket and a few months later traded it on a 997. It's not honest but it's the same shit if you buy it from a dealer.
