Yes they are illegal. Federal law (FMVSS.108) states there must be a red reflective surface visible from the sides and rear of the vehicle.
There must also be an amber surface visible from the sides of the front.

in ny there illegal too i remember i had smoked taillights on my si got a ticket from a state trooper that was an expensive ticket cost me more then the actual lights

OP If you'd like, send your OEM tails to Ack and he can smoke them but leave the blinker part of it red.

Yes there are always people that have it done that could get away with it all day. But there are also those that get pulled over repeatedly. If you pay close attention to all cars on the road, they all have a clear reflector. Look at say a 2008 3-Series Bimmer, they don't have any amber in the headlights, but have a separate amber reflector right in front of the front wheel.
Just like window tint. I knew the law, went darker and paid the price 2 times before i got it fixed on my old car. I learned my lesson and went legal on this car.

Most cops won't bother you. Usually they don't care if you have custom ones. They will sometimes ticket you if you put a crap load of tint over them, but they usually won't care if you aren't d-bag. But over-tinted taillights look like crap anyway.
Cars are required to have red reflector on the rear that can be seen from the side and also just like the front needs to have an orange reflector that can be seen from the side.
Now these rules don't mean that have to be on the headlight a lot of BMW have the reflector as part of the bumper and the newer mustangs have Blacked out tail lights stock but have red reflectors on the bumper

hmmm I managed to pass inspection in NJ with taillights that are almost identical...in fact the clear part is even smoked a little bit....I thought you just needed red/amber turn signals...woops?

Only emissions testing now in jersey. So all of us with window tints can pass too
Everything is going to depend on the cops you see on a regular basis. I drove for several years without a front plate, never got pulled over once. The company I work for moved 10 miles, making me regularly drive in an area I don't frequent often, and I got pulled over within a week. The cop was nice about it, but told me that he's going to stop me again in about a week if its not on by then.

Most cops wont care about clearing out tail lights, as long as the sections still glow the right colors. Don't put dumb blue or white bulbs in for turns, or white brake lights or something.

Clear tail lights must have the DOT stamp somewhere on them to be truly legal and your color pattern are correct ( Red for brakes and Amber for turn-signals.)

Not necessarily. A manufacturer can put the DOT/ SAE stamp on a lens without it actually being tested. Ask APC how that worked out for them. Each manufacturer is responsible for their own testing after having been certified to do so. They also may certify a clear lens, then just use the same tool to produce a smoke or carbon fiber version, but never truly test it. The testing has to do with the light output at certain distances and angles plus the reflectors.
^This. Also, amber reflectors are required on the front of the vehicle, so cleared headlights or the USR clear diffusers are illegal as well.
