Small Accident, but its still =(

i was just drving 5 mph in heavy trafic and den all of a sudden a punch buggy smashed into the right cornor of my rear bumper


the guy offerd to fix it since it was obviously his fault , and said he knows a body shop , so he took me there and they said they was just put body filler on it and fix it, i said no that i want a new bumper and that he could just paint the lower spoiler and paint the new bumper and he didnt want that, so i told him that im just gona call the cop and report it


but after wait for 2 + hours for the cops he said that he would give me $300 for the new bumper and then i come back to him on monday and they will paint it and den paint the lip aswell, so i said ok, cuz i just didnt wanna have another accident on my record

and since the accident (not saying its related)

the d on the dash board , that shows which gear u are in P R N D 1 2

is always blinking no matter which mode im in and the check engine light is on

dose anymore know what that means?

YOURE DOING IT WRONG...

1) always call the cops no matter how bad the accident is
2) Get all his info and his insurance
3)The "I gotta guy who can fix it" deal is old
4)How does an accident of being rear-ended deem your fault?

Yeah, you gotta call the cops. It's not going to go on your record if it was his fault. You are kinda screwed now for a couple of reasons, especially if he fixes his car and says "I never hit you". Plus, can you trust a guy driving a bug?...hehe.jk.

i didnt know i just didnt know that it wudnt be on my record if it wasnt my fault, i always tought it always goes on no matter what cuz nyc is a no fault state, but i guess i should of waited for the cops , hopefully it works out well, i just didnt wanna have to go trough the long insurance claim again


but how long after a accident do you to make a claim? i got all his info aswell , but i didnt give him any of mine all he got is my name and number

Ok.. Stop what your doing and call your insurance now and ask them. Shit you pay them xxx.xx amount every month you might as well ask them what the hell to do. You have a pic of his car thanks god but no liscense plate, but you really need to get on the ball otherwise i see this coming out of your pocket and this damage is in the 500-800 range

There is a reason we all have insurance. My guess he may not have been insured. You most likely have damage under the bumper cover that needs to be looked at. YOU need to always call the cops and have a report done.

Now, it does go on your insurance IF you have to get your insurance involved (like a hit and run) or the guys insurance isn't working with you. Then yes it will go on yours, but it won't be against you as it wasn't your fault.

But now since you never called the cops, and had a police report done, he could say it was your fault.

No fault state? Perhaps you might be mistaken with the rules for incidents within parking lots. If somebody plows into somebody else on the road, I guarantee you there is fault no matter what state you're in.

2 hours for someone to respond? Dang! I thought 45 min was a long wait for a trooper where I live in FL. You would think w/ a force of about 30K NYC would have better response times...but oh well. i live and work in a small populated area (300k +/- 50k). So our response times are a little better....sometimes.....

Something you might want to check into. In FL we have a "blue form" (no longer blue its grey now) that's free and you can get it from the DMV. You fill it out w/ each driver's info, ins etc...and give out the carbon copies to the other drivers and send in one copy to the state DMV so they can record the crash. It takes the place of a crash report, no one gets citied, and your insurance accepts it as a claim and they handle it all.

Dont know if NY has such a form (dont know why they wouldn't) but you might want to call the DMV or check their website to find out.

Does NY have PIP? That is the no fault system when dealing with injuries from accidents. It doesn't apply to property/body damage.

x2, I would take the 300..a new bumper and rear lip is around $700 painted...if your deductible is 1k, it would make no sense.

The hit in resale value having that small accident on your cars record will hurt you more in the long run imho.

I agree with the others. I'd certainly got the cops/insurance company involved. At the very least you'd need a new bumper cover and it needs to be inspected for any other possible damage.

Paint jobs are expensive for our TL's
Estimates for my car on the front bumper was $650ish in Los Angeles from reputable places.. also looks like you have a rear valance? Add another couple hundred to that.

were you drunk? or did you have something illegal in the car thats the only time i wouldnt call the cops
i got rear ended about a month ago and damage looked alot less than that, the other drivers insurance has paid me 770 so far which includes an oem bumper, paint and 2 days rental at $30 per day, plus you have the aspec lip which will be more money to replace, i am just using the money i got to throw the rear type s aspec and cover the damaged area since it was so minor.

No fault has nothing to do with property damage. No fault is in relation to bodily injury.

File the claim with his insurance company asap. Takes you a max of 15 to 20 minutes. They will send an appraiser to look over your vehicle to write an estimate then take it to the shop of your choice.

From the photos appears you may have a little quarter panel damage too.

This is what I was thinkin about right when I read that you didn't call the cops. I'm pretty sure he sent you to a friend's bodyshop that'll do a halfass job so it's cheaper for him. It's pretty obvious, since they were going to do body filler.

Bring him to a shop both of you agree on, and next time (knock on wood) call the cops.

It looks like you SHOULD have gotten the cops involved since this damage is way more than $300. And also doesn't matter he is at fault, when you get the cops involved and his insurance does pay for the damages it will show this car having an accident history. So no matter how you try to cover this up, you are still screwed in the end. But I would have definitely went with the cops since at least you will get the car fixed properly.

In any case where my car gets hit and it's the other person's fault, I'm absolutely getting PD involved. Also my response would be 'you hit me- I decide where my car gets fixed, not you'.

no i did call the cop and wait like 2 hrs and they didnt come, so i was like whatever just fuck it, everything should work out, i went to the shop today and it looks good, they have a spray booot and everything looks good, ill post some pics after its fixed

Exactly what happened to me albeit your accident was at a much lower speed than mine. Those VDubs do a hell of a lot of damage, don't they?

I agree with everyone else...you should've reported it. Even if the police don't show they'll issue you a report # which you will need for a claim. If you were stopped and he hit you from behind, he is totally at fault and liable for all damages. Ontario has a "no fault" insurance policy as well....all it means is that you don't have to pursue the other person's insurance company for damages regardless of who is at fault for the accident. It doesn't mean that all are absolved from fault. So if he ran into you while you were stopped, his insurance company has to pay for all damages and costs....you not be out of pocket for any costs and the accident will not go on your record.

Too late now though...call it an expensive lesson learned. That damage will be waaaaay more than $300 to fix properly.

Not sure if the laws changed in Pa but when my car was hit from behind a few years ago I called the police. The state troopers showed up and I was told-if I could drive the car and no injuries do not call them. Just exchange insurance with each other.

where in queens did this happen? I sure hope it wasnt the 104 because they suck.
When I was in my car accident. It happend at 119pm.
Cops didnt arrive until 448pm. OVER 3 hours.
The precient was less than 2 miles away.

You can still file a police report after the fact.
So long as you have other parties insurance info, time/date and place of accident.
Certainly the officers will ask why it took so long. I guess you can tell them they never showed up.

not necessarily true. I contacted my insurance company immediately following the accident and couldnt supply them a police report until like 2 weeks later.

The only way for the cops to show up in merely seconds is to get the ambulance involved. When dialing 911 and the operator ask you if you are hurt, this basically tells them if they need to show up immediately or take their sweet time.

Even then that wont get them to the scene any faster.

The only agency that responds within minutes is the NYFD.

Kudos to them for being responsive when you need them.

There isn't an insurance company out there today that requires you have to have a police report number in order to file a auto claim. A police report can definitely help in an investigation but there are certainly other ways to determine fault in an accident. A police report may also show one person at fault, but that doesn't mean the insurance companies will agree with who the police determined to be at fault.

Today a lot of police agencies all over this country are not responding to non-injury accidents. The best thing u can do when in an accident is to take photos of the scene from all different angles before the vehicles are moved and then take pictures of the damage to each individual car.
