OP. It's a good thing that you filed a report. Some insurance companies will not pay you a cent if you haven't filed a police report. It's part of the paper trail that they use to go after the other driver (in using the cop's report to find fault.)

Uninsured motorist will go to jail or get sued by your insurance company. I have been hit twice and they went after them. So don't worry about that he will get it.

Thank you! But, mostly independent shops are not connected with insurance company right? so you guys mean that i should go to the body shops where are not connected to my insurance company..
I know u guys might think that why I want the check rather than just fix my car under insurance,
but you know what? I already went to body shop and they estimated 3000 for cash deal...
which means it will be way more then 3000 dollars if i go through insurance and not get fixed properly.
Question is what if the limit is 3500 dollars but my car's estimate is more than that?
Do I pay the difference out of my pocket? hell no..

Go through your insurance. I work in the insurance business as a claim appraiser/adjuster in MA. Your insurance will cut you a check to you or shop of choice, during the repair process when your shop finds any additional damages, they'll inform your insurance company and they will work out on all the labor and parts, which is called the supplement process. I'd recommend to bring it to a reputable shop.

He'll have to appear in court. In the long run, you can take him to small claims, but your insurance company will try to collect the damages they paid through your policy. You can try to recoup the deductible, and depending on your state laws, you may be asked to appear in court as a witness. Good luck.

This sucks, how much is your deductible? I got hit one time by and uninsured motorist and I was pissed that I had to pay for something that I didn't cause and my deductible was $1000.

Yeah, but I do not have collision policy and comprehensive..
I only have liability option and uninsured motorist policy...
So, I do not pay any deductible and there will be no other coverage covers but uninsured motorist property damage with 3500 limit..
I just wanna get the check for the estimate and fix it with cash deal..

I have never understood those that drive cars that are worth more than $3k without having comp and collision. Do you really save enough money to justify being out of a car if something happens? Heck, I kept comp/coll on my 8 year old Cavalier because the $20 a month I saved wouldn't replace the car if something happened to it. Did the same for the wife's previous GrandAm for the same reason. One little accident no matter who is at fault could cost me $3000 to buy another car or a $500 deductible as long as I paid the extra premium.

I have a friend that drove another friend's 350z back in college, totaled it. turned out he only had liability on it so the car was just gone. Owed like 17k to the guy.
OP, blah blah blah talk to your insurance rather than a forum. We dont know the intricacies of your plan.
