This is why you test items before using/installing them. Whether they be used or new, it does not matter. Sure, you can take the risk of trusting someone that they were working when removed from the previous application. They might have been working perfectly, but after being removed they might not. Even if I was in this situation and bought the TPMS off of a family member, I would still do anything I could to test them before potentially wasting my time and money installing them.
The seller stated they were functional on his 06 TL with aftermarket rims. So you have a 50/50 shot that they are still good. The only time I do not test something being installed is if the seller/business is the one doing the install. If it doesn't work, they will most likely exchange and do the work again free of charge as it is THEIR stock installed by THEIR technicians.
If you go to Autozone and buy a set of brake pads, bring them home and they don't fit right, is Autozone going to refund you for your lost time? No. They most likely will offer to exchange or return them at best as long as you haven't completely knackered them when trying to install. This seller is allowing a refund of the additional $40 for the TPMS.
However, I do see the confusion that could develop from the wording of the deal. One can argue that given the seller wanted $300 for the adapters and $150 for the TPMS, the value of the TPMS had to go someplace into that $340 price. But the seller was also very firm on his price several times of $300 for the adapters and $40 more would include the TPMS with shipping. This is where the discrepancy is. Had the seller CLEARLY stated "$300 for the Adapters, $40 for the TPMS and I will cover shipping costs", this would be cut and dry.
Personally, I agree with both sides. But as stated in previous posts here, I do believe you should both meet in the middle as both sides are at fault. It is a bad experience for both of you. Settle it like gentlemen.

Both parties in question have had a chance to have their say and layout their story. Members can judge for themselves if anyone is "right" or "wrong" and act accordingly.
A "he said, she said" argument won't do any good and neither will additional flaming from the peanut gallery.
IF the two parties come to some kind of mutally acceptable argreement, just let me (or ggesq) know via PM and we are more than willing to post an update in this thread.
