I went through something similar with Paragon Acura in Queens. They gave me a really good price and then sold my car to someone who was willing to pay more. When they called to tell me my car was delayed, they "just so happened" to have the same car with $2,000 dollars worth of add-ons (which I hadn't ordered on mine) that they offered to me. I made a big scene and suddenly they were "able to move things around" and get me my car as promised. When I went to pick it up, they lowered the price on my trade-in and I ended up walking out. I got my deposit credited back to my credit card without any problem. The receipt I had stated that I was due a refund if they didn't deliver the car as promised. Technically they had, but they still gave me my refund. The price they gave me was so low they didn't want me as a customer.

I ended up going to Rallye, and I'm just loving this car!

Anyway maybe the dealer has regrets about the price he gave you and is selling your car to someone else.

One sure fire way to get your money back is to go into the dealership when it is slammin jammin busy (i.e. all sales people are with cu$tomer$). Speak to the sales manager and ask for your money back. He will refuse. Speak louder and ask for your money back. He will again refuse. Speak a bit louder and start turning the heads of the cu$tomer$. I find that Saturday afternoon is a good time.

I had to do this for an old Honda that I put a deposit on that never ended up showing up at said dealership (I went and bought elsewhere). They jerked me around and around, so I went in and asked for the sales manager. When I was continually refused I simply got REAL ugly "What kind of racket are you running here, you get my deposit and then don't deliver, and now that I have bought elsewhere you want to keep my money" etc etc etc it was amazing how quickly the sales manager came out and greeted me, then quickly escorted me into his office and closed the door. He tried to have his way and offered me a "business check" with a 6 to 8 week turn around. I told him that I was going to warn EVERY customer that came in the door that the place was tainted. I walked away from that dealership with CA$H for my original downpayment.

The receptionist asked me if I kissed my mother with this mouth of mine

I hate to have to break it down to this level, but it is the squeaky wheel that gets the grease!!

its true on my form it says that if i do not receive the car in which i ordered within 30-days i am entitled to a full refund of my deposit. you should check the form again and read the fine print. i assumed this was the law and they can't take a deposit and keep holding it for as long as they want. i feel bad that you had such a terrible buying experience at island. i almost bought mine from there but went to rallye instead. the sales person i got there was really shady, he was real nice to me when i was looking but when i was shopping at other Acura dealerships his communication went down the tube.

How about this situation: I gave the dealer a check as a deposit for an order but also told him to wait with cashing it till I call him to make sure there is enough money in the account. In two days, I cancelled the contract because I found a better deal somewhere else and asked the dealer to destroy the check. At the same time, I put no pay on that check at my bank just to be sure they did not cash it. Can the dealer demand the money because I signed a non-refunadable contract?

if you signed a non-refundable contract then your money is their's. just because you asked them not to cash it doesn't mean they will not want it. was your contract non-refundable? if so i think you better talk to the dealer and make sure everything is ok. if he tries to cash it in a couple of days it will bounce and they will be made and you will get charged for the bouncing fees. but if the dealer said it was ok to cancel the order and he destroyed the check then you have a nice dealer.
