Is anyone surprised that some one at the DMV office made a mistake? I am not.

One of my friends went to DMV about 3 month ago to renew his expired driver's license. After standing in line and handing over an application he noticed that person behind the counter became very nervous. Then DMV person went to the back and was talking to other DMV officials for a while and everyone start looking at him with some kind of suspicion. Turns out he was DEAD in a DMV system. He had to go do social security office to sort things out.

If the car indeed had "water damage" that doesn't necessarily mean it took a swim in a river or something of that nature. I've seen a couple of cars that were totaled by the insurance companies due to "water damage" that didn't actually have anything wrong with them.

From what I understand, many insurance companies will total a vehicle if it gets flooded up to the wheel hubs. This is mostly to cover their own ass, because damage from that kind of flooding is unpredictable. The car could be completely fine in some scenarios, or major parts costing thousands of dollars could be ruined in others.

You might have gotten a "flooded" car that has nothing wrong with it. I would advise that you check your transmission fluid on the dipstick, as transmissions often get flooded, and the water is almost impossible to get out.. If it's relatively clear then that's good. If it's sort of milky/opaque, then that means that the trans has been flooded. I would also look under the body for obvious signs of rust or water-logging.

Either way, even if it is a good flooded car, the dealer definitely owes you some money back, as the salvage title kills resale.

NBP... I have a 04 and the seats look exactly like that!! Do they have two or three "panels" on the bottom? Can you post a full pic?

DO NOT SIGN over the title.

Why can't they just mail it to you. I would definitely inspect the carpet for any wet stains.


I'm just curious on your initial post that a previous owner encountered the same thing?

Well how am I supposed go get issued another title if I don't sign over the old one? They said it was about 4 years ago that a woman bought a brand new car and had a rebuilt title sent to her.

Also, I called the DMV myself to double check, and they said that the rebuilt / water damage was only on the title issued on 07/02/2012, and all the previous titles were clean, meaning it was mistakenly applied, right?

Not a rebuilt but the dealer/dmv messed up my title...I bought my car new in 07 and when I finally paid it off, I got the title with a notarized revision stapled to the back. Hopefully all works out for you.

There is a lemon law in US stating that dealers cant sell salvage/rebuilt title cars. so my best advice is return the car and try to get you money back.

I don't think they are 2004. From what is shown in his pic, they are the same as my 2006.
2004 had different stitch seams than 2006. Not sure on the difference between '06 and '08 though.

What happens when you list this car for sale a few years down the road and one of those databases has your car listed as salvaged due to the DMV mix up? Or the next buyer goes to register it like you did and they receive a salvage title from the DMV? I don't know about you, but if someone tried to tell me "It's a DMV mix up, I swear, it's not a salvage title this happened when I bought the car too!"... I would demand my money back or refuse to buy the car depending on what stage of the sale it was discovered (if discovered). Just trying to think long term for you. If you can still return the car, it might be less of a headache than trying to sell it later on down the road. Plus if you can get your 19k back you could purchase a 07/08 type-s from a private party depending on your local private listings (might need 1-3k more depending on your area).

There is no differences between 05-08 seat may be for extra cushion? or the newer 08 cushion didn't wear as much as 05-06. Type S receive extra stitching compare to base model.

Glad to see you got it resolved. For future reference, and anyone else who seems to have an issue, i have found that the threat of being sued is just a joke to many dealerships. The real way to get them to step their game up is to contact the local news. Bad publicity for a dealership can run them out of business. I was scammed, twice. Once i paid cash for an older Infiniti and when i received the title it had a leinholder listed. Another time i was sold a car which the transmission blew the next day. They claimed it was a coincidence and that it wasnt the tranny but instead a line, which isnt covered by the ny lemon law. Well finally i got them to agree to have it fixed, took it to their shop, and it sat there for a whole month bc the dealership then refused to pay the mechanic. Whole big headache took monthssss with no resolve, until i told them i was calling the news so dress nice tomorrow when the cameras come in to put u on tv. It was paid in the 2 min following my exit LOL.

Not sure about the seats... however, the headrest appear to be from an '07-'08 TL, as the basic shape for the '07-'08 TL is / \ as compared to the '04-'06 headrest basic shape which looks like this \ / hope it makes sense.

Those 2007 seats are different than the ones pictured!!! I am not sure if Type S has different than regular TL.

Either way, I would 100% take that car back. They need to give you your $$$ back, plus some extra. If they give you any hassle, I would simply have a lawyer write a letter stating the facts... Bought the car as a perfect car, title stated rebuilt.

You can further your case if the car was CPO. They it was REALLY misrepresented.

Your S seats look different than mine 2008 regular TL. If it is in fact a DMV's fault then he doesn't have any legal ground to return his car. 1. Dealer sold good car 2. Buyer bought good car. 3. DMV made mistake. It is very easy to tell if the car has been painted or rebuild.

There you go. Type S and base '07-'08's are different. OP has a base, so there is not supposed to be extra stitching.

brother let me clarify everything for you in this one post

on the bottom of your seat if it has 2 panels then its from an 04 model year car

on the bottom of your seat if it has 3 panels then you need not worry

type s is the only one with 4 panels for all you others out there

04 TL



05/06 + TL + 07/08 Base TL (with different headrest and bolster design)



07-08 Type-S

Not true, maybe your state or county has that law but there is no Federal law against selling salvage/rebuilt title cars. I have a friend that does this for a living. He discloses that they are rebuilt to the buyer however.

Also when I worked in the Automotive industry I personally have seen Titles misslabeled as Salvage/Rebuilt/incorrect mileage/etc. It's actually more common than you would think.

That must be it because there are dealers around here who sell salvage cars too. Most don't, but a few do. But they obviously say beforehand that it is salvage.

God damn it guys stop purposely looking for things to pick at, he alrdy has the right seats and the DMV made a mistake, stop being so skeptical about everything. How would you guys feel if you just bought a new car and instead of people welcoming you to the forum they keep finding bad things to say about the car. Based on what I read in this thread I honesty feel that the DMV made a mistake, so I mean so what? Doesn't mean he needs to return the car now. Car looks great, probably better than some of you guys here who are critiquing his car. People are probably just jealous his seats look to be in better condition than their seats. Most 04 seats are pretty worn out by now.

Is not that good of a deal to find it hard to believe. I got my 2008 TL for 22k out the door and is CPO clean title, 38k miles.
