I wouldn't worry about the CARB vs. Non-Carb version. I think they will make one version and hope/expect it will be Carb legal.

carb legal is just a sticker attached to the intake in case you get pulled over in california with the intake installed. It just states that its smog legal, thats all..

You only have to worry about water getting into the intake if the entire pipe is submerged. I dont think anyone on this site will see water that high and try to drive thru it. When I got the intake for my 01 CL-S I also got the bypas valve but never installed it. Drove the car in rain etc thru puddles (nothing too high) and had no problem. If you need piece of mind by all means get the bypass valve. In the event the entire filter get submerged the bypas valve opens allowing the engine to breathe air from the engine comprtment preventing the water from entering the intake tube.

Thanks for the clarifications, guys. I figured Injen was just covering themselves, and it was nothing to really worry about. No one would install these if you couldn't drive through a rainstorm! In any event, other than the extra cost, is there any disadvantage to installing the bypass valave?

Some valves have been know to fail (leak). Instead of getting cold air from the lower filter the valve's seal opens allowing hot engine compartment into the tube negating any gains from CAI. There is a way to get around this. During dry times instead of the valve use a silicone hose to cover the gap caused by the valve and when wet use the valve.

it doesnt pull air from out front, so its not a true cold air... a true cold air pulls air from the front end of the vehicle.. ie.. tube piping and air filter behind the front bumper, not in the engire bay..

It appears as though "the group" is antsy to see the dyno sheet from Injen. Since you are without digital capabilities, maybe they'd post for you? I'm guessing they'll dyno your TL again when you return for the check-up.

im in if it really works i need to see it for my own eyes i dont know about whp maybe at the crank!!! no way you gained 15 to the wheels noway i need to raise the B.S. FLAG I think

No reprogramming of any sort took place and runs were made on the same day, correct?
Cold air can work if there is a big difference in temps before and after, but the continued lack of a dyno sheet seems very suspicious.
