help with trial by declaration

I got a red light ticket in LA last spring and I got an extension of payment and now the due date was nearing. I recently logged in to www.lasuperiorcourt.org to relactuntly pay the ticket, but just found there is an option for 'trial by declaration' which when I google, to my understanding, 'fighting the court without going to court'.
Chose that and they said they will send me the form, but I still had to pay the ticket by entering credit card info??!.

Can someone familiar with it explain to me, how am I supposed to fight the case, if I pay the ticket at the same time. Or are they going to refund it, in case I win the case? Thanks!

If you want to fight a ticket in Ca you have 2 options
Pay the fine up front and get a court date or other appointment time some days or weeks in advance
OR
stand in line at court on any day with 1000 other people
but not have to put up the fine ahead of time

If you lose they keep the money--they want it up front because if you lost and didnt send in the fine,,,more hassle for them to come arrest you

If you win you get a refund
Now lets look at the State and city budget and ask yourself- will they find me not guilty and ever send me a refund? NO!
they dont lower fines or cut you a break, not without some major good reason --of which there are few~

red light cameras dont lie- are well tested at the intersection in use, and a major money maker for everyone
Chances of you winning? unless you were clearing the lane for a fire truck or police with their red lights on...forget it. You ran a red light

were there special circumstances?

also - you got an extension to pay, meaning you agreed to guilt and fine
Now months later at that payment deadline you want something from them?

NYC parking ticket rant...

I live in Manhattan, when I have my car, I usually park it on my block and drive to work by 8AM, parking is allowed on my block form 6PM to 8AM.

Anyways, got up this morning and walked out of my apartment at 8:00AM sharp according to my watch. Then I saw a ticket agent writing a ticket for my car. The car was about half a block away from my apartment door, and I ran up to her:

"Come on, my watch still says 8AM"

She didn't even look at me:

"There is no grace period, and you can fight it if you want"

Then she walked away.

I picked up the ticket, and it says 8:02AM. Couple of pedestrians actually started cursing at her.

I respect NYC cops and traffic agents, but this is a bit out of line. Total BS.

Next time you should take a pic with ticket since the camera show what time you took the pic and bring it to court. What worst is that people who got ticket before you is not even at 8am.

We parked in midtown one time and i walked down to the machine to get the ticket to put in the window. As i am walking back i see a parking cop writing me a ticket. I told him I just walked down to get the ticket (literally less then a minute) and i showed him the ticket. He looked at me retardedly and after a minute of me basically yelling at hime he backed down and said he would not write the ticket (like he was doing me a favor). I told my wife to hold on to the stub because I didn't trust him. Sure enough a few weeks later she got the ticket in the mail. She tore them a new one...but what a pain in the ass.

Dispute it and put exactly what you wrote here in the letter, they should dismiss it. This has happened to 2 of my coworkers recently - they got tickets at the precise time that the restriction goes in effect and both tickets got dismissed. If you want I can email you a copy of the letter if I can get my hands on it

something tells me you are not a lawyer

i live in manhattan too - but would move out if i needed constant access to a car (car @ fams place in the burbs)...its really not worth the headache, unless you could afford to garage park.

theres no sense in ranting about a parking ticket in NYC - you knows its going to happen - thats the risk you take.

You are guilty until you prove your innocence with regards to RLC tickets. So you'll need to pay up. You should do the written declaration since you have nothing to lose but a little time.

I fought a red light ticket using the Written Declaration last year and won! Since then, a couple of other people used my technique and also won. You need to look at your late time (time after the light turned red- it should be in the captioning in your photos). Providing you're not super late (like less than .5 second or possibly even a second), you should be able to find a couple of other 'comparable' intersections in the area of the ticket. Ideally these intersections should be on the same street. Use a video camera to take video of each of these intersections yellow light intervals and compare those intervals with your ticket's intersection. The video shoots at 30+ frames /second so you can get a very precise measurement of the yellow light interval for each intersection. You want to show that other intersections have LONGER yellow light intervals than the intersection with the ticket. Ideally these intersections should be longer than your 'late time'. Your argument is that how does a driver know what the proper yellow light interval is when there is significant variance in intersections. Of coarse the reason for shorter yellow light intervals on camera enforced intersections is that it's easier to get a red light ticket and is very profitable to the city as will as camera vendor.

I enclosed a long document with a DVD of video taken and got my money back in less than a month.

Good luck and don't be pushing yellow lights anymore!

Quite a few people can beat red light tickets...just depends on how well you can explain why the yellow light sucked.

I have an upcoming ticket due date (speeding - broken speedometer) I'm really not looking forward to handing over my money ahead of time because I'm pretty sure I won't ever see it again...I think they will really clamp down on a finding of not guilty

Well, I just received my first speeding ticket in 15 years.

While heading down to Virginia Beach via Route 13, I was apparently* tagged by LIDAR going 62mph in a 45mph zone. While I was clearly exceeding the limit, probably the worst part is that I was not particularly trying to speed during this trip as I was attempting to get the best gas mileage possible, not to mention having my wife, wife's aunt, two daughters and a load of weekend luggage and beach gear in my car.

Anyhow, the road has a 55mph speed limit for miles upon miles prior to entering some one horse town called Felton, Delaware, where the limit apparently drops to 45 mph with no warning of any impending 'speed zone'....rather, the limit simply drops. (note the link above; the first instance is how I was snagged....AVOID this town)

There are times I'm moving at seriously high speeds but this was definitely NOT one of those instances.

Does anyone know if points from Delaware transfer over to NJ? (Granted, I have a clean NJ record so, I don't think 2 pts are going to hurt me much as I've carried continuous coverage for some 20 years.)

* sidenote: although there is no advanced warning when it comes to LIDAR, I'm a bit miffed that my Escort Solo S2 (w/a full 4 bars of power) did not pick up the signal....at all.

Hopefully this wasn't anyone on here. Apparently some 16 year old kid caused a pursuit last night on Rt. 17 in Orange County, NY, top speed 111 mph. When he finally got stopped, he was of course arrested and car towed. He ended up with 56 tickets in 4 towns, from 2 cops. He laughed it up until he called his mom, mom yelled, and he started crying.

I bet he won't think it's funny when he has to go to court in 4 towns for all these tickets, has to pay thousands in fines, and won't get his license for many years. Imagine being in college and still don't have a license or car.

Ticket Question

Ok guys, not really a good morning....I was behind someone this morning doing about 70plus mph on a 55mph zone. Then all of a sudden saw a NY Trooper pulled him over infront of me then signaled me to pull over too and so I did.

My question is he gave me two tickets....one for doing 74mph on a 55mph zone and a "failed to produce valid insurance card." Since I accidentally gave him the expired one. After finding the NON EXPIRED insurance card and showing it to him, he tells me "TOO LATE NOW."

My questions are: What will happen in court regarding the expired insurance ticket? Will it get dropped when I show them a valid non expired one?

And since Im in NY doing over 11-20MPH the speed limit it is 4 points, will I be offered a lesser charge with reduced points? What are the chances of them offering me a NON MOVING violation?

That sucks. ticket for DVD players. MOst of these cops are abused kids growing up. now they happened to wear a badge and they are on a power trip. I agree with the following video whole-heartedly.

No idea because it is NY law, but maybe Texas law can give you a point of reference.

If you can prove you had valid insurance the day of the ticket, the FMFR ticket will be dismissed. This is as simple as showing up for arraignment and giving them your insurance card. They'll make a copy and clerks will call it in at some point and dismiss the case.

The chances of you being offered a non-moving violation are probably nil. I don't know how it works in NY, but here you can take a driver safety course that will negate your points. You'll still pay court costs because traffic tickets are a source of revenue. You couldn't have taken DSC for the purposes of negating a ticket in the year prior to the date of your offense.

You might also be able to get a deferred instead. Deferred is more convenient because you don't have to take a class. You will end up paying your fine and your court costs, and you have to avoid tickets for a period of time (here, I generally offer 180 days).

Sorry it happened, but once every 15 years is not a bad record at all! Lidar (commonly referred to as laser) is a really narrow beam, so unless the officer checks the car right in front or right behind (or n the side)of you, your detector will have a tough time picking up any of the signal to give you an alert until the officer already has your speed. I am surprised, though, that your Solo didn't give you ANY alert. Then again, if the beam was aimed at the lower front of your car it may not get enough signal to trip the alert...

I love Indiana. Every cop here still uses radio band detectors. I've heard a laser warning maybe once in 3 years and I'm not convinced that was actually something for speed detection.

so i was leaving wal mart and there happened to be a cop in front of me. She caught me putting on my seat belt just as I was leaving the lot. And pulled me over. Then she proceeded to tell me that my registration was over a year old. Do I have any legal rights here? I mean I was putting on my seat belt just as I was leaving WalMart - give me a effin break!

Looks like she needed to meet quota....I think, the technical rule states that you have to have your seatbelt on before your car starts to move..But i could be wrong. If thats the case, you were basically busted on a technicality which, could possibly be argued to a judge if you have a good clean record.

Seatbelt laws do not apply in most states on private property. If you had left the parking lot and were on a roadway, you got caught.

Why is your registration expired by a full year?

Why not just put your seat belt on as soon as you get in the car? It takes about 2 seconds, I do it without even thinking. It seems like it's more trouble to put it on while you're trying to drive out of a parking lot as opposed to putting it on when you first get in your car.

Has anyone ever been mailed a ticket from a patrolling officer?

I got on it a little on the on ramp on my way to work this morning and a few seconds later my radar detector was signaling an instant on radar system. I slowed a little and thought nothing of it until I checked my rear view and there was a cop on my ass (I have no idea where he came from) tailed me for a little ways and when I was able to merge into the right lane to let him pass I did and he went on by.

What do you think?

Also, he was a town cop on the interstate and when I was behind him for about 10 mins he was periodically using his instant on. Do town cops even make stops on interstates? Isn't that state cop jurisdiction?

Got Pulled Over...

Yup, another police rant, well not really, this was just kind of funny. I was going 78 in a 70 (drive 50k a year and they will not pull you for this) on the turnpike and was passed by a car doing 85 or so when the state trooper pulls from the middle of the road. I assumed he was grabbing the girl that passed me but decided to get me for my license plate frame haha He said it covered part of "florida" up on the tag which is illegal. I know this is illegal but it is a standard UF frame that everyone has so I wasn't too worried.

He was really cool and told me he wasn't giving me a ticket up front but to roll my windows up so he could see my tint. He said it was illegal at 15% but not to worry, just have it changed.

Any idea why this happened? Just looking for someone or doing a bit of profiling? My friend is a cop and said they were looking for an excuse to pull me over but once they realized I was a "skinny, scared, white boy" they didn't care. I have a copper colored Infiniti FX which does have big wheels (20s that came stock) and black windows so I guess I looked shady. Had to lighten the cop mood in here, this cop was really really cool and he was a trooper

I had an okay experience last Friday.

Got pulled over for:
Speeding - 85 in a 65
Tailgating - jack ass in front of me wouldn't move over
expired proof of insurance
expired tags - but had the new tags in my glove box

She asked me what the reason was for me driving like that. I said "no particular reason" when I should have said "I wish I had a good reason."

Ticket was:
Warned on speed
Following too close - 1 point
expired tags - fix it
expired proof of insurance - fix it

No mention of tint or no front license.

Now I just have to ask the judge to allow me to take traffic school, even though it's been less than 1 year since my last ticket. Maybe I should slow down.

Damn, man. If you got caught doing 85 in a 65 in Oregon they would ream your ass. I always fit the new tags immediately after getting them.

Well...I take the plate off the car to clean it off to ensure a good seal and straight alignment of the new stickers.

IMO when they pull you over for stuff like this they are looking to see if you are drunk or doing something else dumb. About a year ago I got pulled over for a rolling stop in the middle of nowhere, he let me go.
