Resolution of 2020 MDX with worn rod bearingss not covered by recall
Guys,
Last spring I posted about our 2020 MDX, under 40K miles, with severely scored rod bearings. The VIN did not come up as covered by the recall. American Honda would only cover under warranty, replacement of the rod bearings. So, not satisfied with that, I sold the car back to the dealer and sued both them and Amercan Honda in small claims court for loss in car value, costs incurred in purchasing a replacement vehicle (taxes and fees) and other costs in time and energy researching, documenting, and filing the claim. I received the judgment in today's mail, I won the case against American Honda but the court only awarded me $4,000 for loss in vehicle value and $172.05 in filing expenses. The dealer, who was guilty of some bad behavior, is off the hook. I'm disappointed that I didn't get the replacement vehicle costs, roughly another $4,000. I'll leave it at that for now. It got to be pretty complex, at least from my perspective. If there are any questions ask away, especially if there is anyone else out there who finds themselves in a similar situation: worn rod bearings but not covered under recall. I put together a technical paper that makes a pretty strong case that the repair was inadequate and the judge bought it. Cheers and Happy Holidays, Jim |
