First accident

Ok so i just got into my first accident. I was trying to merge left and i hit this lady. By law the cop said it was my fault it this true? I took a hit near the back left of my car and she took one near the front right. Here are two pictures of the damage. Of course I am in the grey Acura. she wants me to paint her whole bumper, as if. Also what should i do to get the mark off my Acura.

Yes, it is your fault by law.

She was already in the roadway, therefore she has the right-of-way.

Gotta look over your shoulder, man.

Did you know she was there and thought she was letting you in? Or did you just go for it blindly?

The door shouldn't be too hard to repaint -- it can just come right off. The lower part of the fender may be difficult, though. Because its such a large piece, they have to make awkward cut points.

Of course, you could try touch-up paint. But that will probably look like shit.

edit: On closer inspection, it might be buff-able. How does the scratch feel? How deep is it?

Oh ok i thought since i was hit from behind that it wouldn't be my fault. The scratch on the bottom isn't deep at all more like a scuff to me. I think that her tire hit me. Man the funny thing is i was pulling out of Acura after getting my seats repaired and battery changed.

The bright side is that the damage looks very minor for u and other party. Glad that no one was hurt.
Unfortunately accidents happens. I had a similar thing happen to me. My whole lane was stuck behind a parked bus. After the first car left my lane, i creep behind him to change as well. My left corner bumper was a little bit in the other lane, and the car that was one car behind me changed lanes and hit me right as i looked in my blind spot. I was as fault but luckily the other guy was nice and chill. Thank God that no one was hurt, but the total cost of the accident was about 3k damages for both parties. Here's to paying higher premiums for the next three years. lol. Unfortunately being a young driver(me), experience cant be obtain no matter how good a driver you are.

you made an unsafe lane change. you also admitted when you said " I was trying to merge left and i hit this lady."

if that is paint transfer, then yes it can be buffed out. if its a scratch and it took out your paint, you'll have to get it repainted

yea no one was hurt. i just like tapped her. But this lady is really not chill she called 911 like 3 times and then was trying to have me call 911 i was like no thanks. And then she was like oh im gonna need to have the bumper repaired and painted. I was like the hell you are. Either way the cop told me that since we have the same insurance company she wouldn't get any money and that i wasnt gonna get a ticket because the lady really had no damage to her car.

honestly i dont belive i hit this lady because as soon as i saw her i pulled away but i think that out of shock she pulled the same way as me. Cause her tire hit me. The only way to tell would be figure out if the back or front side of her tire hit me though.

After looking at the photos i took it does seem that she might have turned into me. Because when you start to turn right the front part of your tire sticks out. And by looking at the mark you can see that the front part of her tire hit me. If the back part of the tire hit me then the swirl would be curved the other way.

LoL you know whats funner she told that one of the scratches on her door i made. She pointed it out by touching it. And you know how if u have a dusty table and u run your finger across it it leaves like a mark, well that happened to her door when she touched it so i was like if i had hit it then you would be able to tell because there would be a mark like that one lol.

unfortunately i didn't tell the officer at the scene. I didn't really get to give my side of the story to the officer. The other lady just told her that i was merging and she tried to stop and then like we hit each other. the officer asked if i agreed and i said yea. I mean im 17 this is my first car i was more scared of my parents then the cop. My dad was so angry that the cop told him to like leave. so i was really nervous and scared. But that prick of a lady filed a claim and insurance just called i told them that i dont feel comfortable giving a statement without my parents.

The lady's Shitbox didn't even seem like it took any damage, but she wants her whole bumper repainted? Give her the finger, seriously. The lady seems like shes out to get your money. The damage on your car is going to cost way more than hers, because her damage... there isn't any really from the pictures.

thats exactly what the cop said minus the finger. Either way we have the same insurance company so i know the insurance company isn't going to pay up. They have to play nice right now and look at the damages but even the cop said that they will fight it 200% to not pay.

Yeah, she isn't going to get paid from the insurance company. Insurance company doesn't pay for minor damages, and any good person would have let this case go.

If two people were in the accident but the car was at fault took the most damage and the damage on the victim isn't visible or no damage at all, they usually let you go. They let you go because the damage isn't great enough for insurance to pay the person that got hit, but this lady just wants money.

The damages r way under $500, so its highly unlikely, she will get much. Remember that the police report is not entirely used by the insurance company to determine whose at fault so ur story can still be investigate, but if ur already given a statement to ur adjuster then ill just leave it, and move on. Also remember that ur insurance will protect u from future suits as well, so if she sues u down the line in the next two years call ur insurance and let them deal with it.

if some one hit me, and there was no damage I WILL STILL FILE A REPORT.
I dont want money, but I am covering MY ASS, incase anything does arise out of the situation.

I'm sure you would do the same thing if some one hit your precious M3.
oh wait I forgot, you have money and can replace the M3 if a scratch arises

Since she did file a claim even though i told her i would pay someone to buff out the mark on her bumper, if her claim is denied which it should be i wouldn't have to give her that offer again right? or pay for anything anymore since she decided to go the insurance route.

If you say those words, you might actually win the case and you get paid. Because if I was a 3rd person viewing this case, I would think too its true that she hit you with her tire. Cause looking at the pictures, your damage makes a curving shape which explains the tire hitting your car.

The police report i understand but the insurance claim is just ridiculous. I mean even the cop told her that she wouldn't get any money from the insurance.

I still file insurance and police.
for my sake and piece of mind.

its not about money. its the fact that some one hit me. what if down the road something happens to my car that was a result of the so called accident?

Do you ever get tired of hating on me for being a M3 owner at a young age? I guess not. Replacing a M3... I think that's a little crazy, don't you? Rich or not. Replacing a 70 grand car is stupid, financially.

I merely mentioned that a lot of people would drop it, because they are nice enough too due to the lack of damage on their vehicle. I seen a lot of people willing to drop the case from witnessing accidents. They don't want the hassle of going through the the trouble with the insurance company.

incase any one hits me! thats why....even if its minor i'm still going through my insurance.

Say something like you were merging, but saw a car (her trunk) and there was enough space so you merged. You then later continue, as you were merging you saw her speeding up and you pulled back but got hit anyways *Shows pics of tire damage on your door.

I'm not telling you to lie, but a story that backs up your case. No one wants to lose in an insurance claim. Right now its down to pictures and her words vs yours. Just tell the better words and you'll win.

I don't know about that.. I was always taught if there was enough space(distance) during merging you go.
