haha yah...but thats wut my gf's lawyer told her to do...nothing wrong with it...she has the right to sue, and she also has the right to give me gifts (such as a supercharger... ) so there is nothing wrong with it...

however, insurance has jus looked at my car, and said the damages are about $17-18k...and they will need to take apart my car and check the engine to make a final decision...but pretty much, if the engine is damaged, its a totalled car, if not, they're gonna fix it...so i'm just waiting on the results, and then i'll decide what to do.

Don't post that up man. Your girlfriend is sueing you LOL or don't tell the insurance company. They'll look into your case and lagggg as long as they can to pay the damage to your girlfriend. Plus you don't want the insurance company to put that in to the computers for their side note. Just say she is a business friend and tell your gf go to a doctor and say she has cronic pains that cannot be fix but I would never do somthing like that

the only reason she is sueing me is because this accident may be labelled as either the other guy's fault, partly mine and partly his fault, or my fault. therefore, in order for her to sue the other guy, she must sue me too, or else the other guy could use it against her.

Hey Wil,

I don't want to burst the bubble....but when the car gets total lossed, you cannot take the stuff from the car that came with originally(Navigation, rims...). That will affect the total value of your vehicle. That mean you'll get less money.

You can only take out whatever you added extra.


Once the insurance comp kills your car, they get your release, and take it to their yard. Then the total lose unit(insurance company) takes over, investigate & calculate the finally value of your car. (Any bodyshop should know this.... )

yah...i pretty much kno that...just that the rims, someone wants to switch them with mine...so insurance wont be able to tell...so that as long as the body shop is cool with it, i can do. and the rear spoiler i shud b able to get too...and maybe some other stuff...

Wilz..as i stated earlier in the thread, I am glad you and your gf are ok. I was actually feeling really bad for you and your misfortune, UNTIL i see that your planning some ridiculous insurance scheme. C'mon man, if your gonna do something this stupid, at least don't post it all over a forum. What if a lawyer or insurance writer comes across this thread? I honestly don't even need a reply because there is no way you can convince me that this scheme is the right thing to be doing. Sorry bro, but you disappointed me and probably a lot of other members of this forum with this plan of yours. :o

er...first of all...its not a "scheme"...my gf wants to sue the other guy for damages, so she talked to a lawyer. the lawyer told her that in order to sue the other guy, she will need to sue me too. thats all...its not like she has a CHOICE where she can sue me and get money or not...she just HAS TO...and they will go in and investigate the whole situation, and in the end, if its not my fault, then my insurance doesn't pay her...i don't see whats wrong with it...maybe its cuz i worded it wrong and it sounds like i'm doing this to benefit from it...but thats not the case. its just some sort of legal procedure bullcrap...

plus most recent updates from the body shop/insurance inspections show that they are most likely gonna fix the car, and not total it (they are not 100% sure yet, and still need to take a closer look at the engine)...anyone have any opinons on this?

kekeke. HIs girlfriend sue him if she wants!!! It's her right. Nothing wrong in that. Dude Eminems mom sue her own son(So what). I'm just saying if they think the claim is fraudalent than they won't pay u right away that's all. If you want to talk about thieves man look at all the insurance companys(that's how they stay in busniess)

Like I said in an earlier post... fight it. They would like to make it seem like you don't have a choice. But you have to question whether they can get the car back to a safe driving condition. The car will never be the same, especially with new front steering and suspension.

What worked for me was getting on the good side of the body shop owner, let him know your concerns and plant the seed that you're gonna be a picky a$$ bastard and that you don't think it'll be a safe car. In my case, the shop owner was the one who convinced insurance guy.

Jeez, looks like everyone here thinks insurance companies are the devil.

The truth is they're not, they just keep track of things. It's their job to make sure that the claim is recorded. The regular joe, however, doesn't keep anything recorded. Sure, we can SAY that the insurance company lied to us, but do we have any PROOF that they did. When it comes down to it, insurance companies have a whole chronological timeline of any correspondence made with the insured, claimant, or any other party that was contacted.

Of course, insurance companies make mistakes, but that's what the Department of Insurance is for. If the carrier breached a part of the policy contract, or if the failed to keep in line with the Fair Claims Practice, then they get slapped with a fat fine from the DOI.

Lastly, and this is for Wilz, how's liability looking here? Do you know what the other insurance company is? Also, if your car is indeed deemed repairable, you might want to argue a diminished value claim. The only problem with taking that route is that you need to prove exactly how much your car was worth before the accident, and how much it's worth after the repairs. That's hard to do, assuming that you weren't in the process of selling your car around the time of the accident.

How much is the estimate to fix the car? If I were you I'd hire an independent estimator (I used Western Appraisers), and if need be get a lawyer. My car was boarderline (my damage was in generally the same area as yours) the appraiser said, I probably needed one airbag to go off to push me over. Your damage was much worse than mine and you had your airbags go off, so if I was boarderline then surely you've gotta be over. To be honest I'm shocked they're going to repair since you've got a damage frame back as far as your B pilar (your B is probably good, but everything around your A pilar is off -- heck your window broke, door is off allignment).

hay wilz, glad your okay, your story was scary, i was actually there going 10E going back to san gabirel from seeing my GF at UCLA tuesday night, heck, that could have been my silver TL thats totaled...... just glad that your okay and that no one hit you from the rear, otherwise you really might be suffering from neck or back iunjurys.

i live in san gabriel, if you can get to your car, take off your parts, and i'll buy some off you, or we can swap taillights or somehting ( i got a 2001) you said you had a stereo system? im in need of some amps, my soundstreams brokedown on me, im also interested in getting some 6000ks,

the preliminary estimate for my car was like $17-18k in damages. but they noticed more damages after they took the engine out for examination (the engine was determined to be not damaged). so there will be a final report tomorrow i think. but it seems that they are gonna fix the car...

as for parts, i will probably not be selling any parts...considering my car may not be totalled, and also if it is totalled, i most likely will get another TL-S and that means i would keep my mods. my stereo i already took out...its sitting at home...but i'm gonna keep it. as for my 6000k hids...3 out of 4 are gone from the accident (as you can see from the pix, my front end is pretty f*cked up) i saved one ballast and one bulb...but same, i'll prob keep it...but if i do decide to sell anything, i'll post it up!

aiight, after about 3 weeks of lagging, the insurance company has finally made a decision:
the car is TOTALLED!!!
now i just gotta wait for all the paper work to go thru, and i shud then get my money, and be on my way to gettin a new car!

as for parts on my car, i have a rear sway bar, two H&R sport springs, a rear spoiler, a rear underbody spoiler, and maybe some other parts.
my wheels have already been reserved, and for all the other parts, if you want them, you must exchange your stock parts with mine, and you will hafta DO IT YOURSELF, or bring in someone to do it for you. also if you are gonna take my rear wing spoiler, you will either need to mount a replacement, or plug the holes. thats all i can think of for now...leave me a msg if anyone wants anything.
