I bought a 1999 3.2 TL on November 29th. I bought it becasue I was driving a Silverado 2500 and realized that paying for the gas going to and from college and work and the insurance for being 19 years old was going to kill me in the very near future. My TL was at Acura of Memphis, and had only 37k on it, I thought I had found the perfect car.
I had, in fact, and loved every minute of the 10 hour drive from Memphis to Clemson, SC. I loved every minute of the drive back home, too. I found this website, and have enjoyed learning about my new car, and dreaming of all the things that I really want to, but never will get around to, do to my car.
Enough Background. Well, here's a little more, I have never had a wreck.
That is until December 16th at 5:30pm. This is the day after my birthday.
So this woman is leaving work, and is white-trash, and hits me as I am turning into the left-turn-lane. She is leaving the driveway as I notice her, prepare to give her the old "honk and wave" but it looks like she stops. So I think, "cool, this woman is only a mild idiot and will not hit me."
She was not a mere mild idiot, but rather a major one. She not only hit my car right between the rear passenger side door and wheel, but hit me so hard that the rear seat passenger (who sat right at the point of impact) lost his flip flop and it ended up in the front passenger's lap. Ok, that was really funny, I mean, he lost a flip flop. When the cops showed up (it took only 2 and a quarter hours) they ticketed her promptly, and told me to have a nice day when the tow truck got there. My car was undrivable because of the suspension damage to the rear wheel. The woman's car suffered a small gash in the bumper, she was able to drive off.
Had it been a guy that hit me, I would have hurt him. But now I really only want to hurt anyone mildly associated with the AllState insurance Company.
I am lucky enough to be a State Farm Customer, and could not be happier with the way they handled this. I am starting a Job at a paper mill in South Carolina (one that is 14 hours away from my house) on the 3rd and would really like it if I could get my car back before then. State Farm said that they would be able to get it all taken care of by the time I had to leave, and possibly in time to go to the Peach Bowl and watch Clemson dominate Tennessee. The bad part is that the woman has Allstate, and they are responsible for paying.
Allstate is unaware that their primary job in this matter is taking care of the people their clients assault.
So the woman who is in charge of my case at Allstate, and I will not use her name only becasue she is a ***** and would sue me, said that they would have to conduct an acciednt scene investigation, and get my car appraised by 3 body shops before they will do anything. Time this will take: 2 weeks, this would mean my car would not even start to be worked on until after I started at work. And, what's worse, she accused me of not only being drunk, but of not having my lights on, and crossing the double yellow line into oncoming traffic to pass unlawfully. She claims that it is partially my responsibilty. If it were, I believe Memphis' finest would have ticketed me as well, though they were kind enough to use their brains.
For now, I am filing this under my insurance and am hoping that I will not get screwed. AllState wants me to pay for deciding to get hit like that; but I really do hope that State Farm is able to pry my money out of the fists of the morons at Allstate. I get the honor of paying my deductable, and the privilege of driving an Accent until my car is ready.
So Really, I am just venting, and thank you for your time. If you have any advice, I would love to hear it.

First, sorry about your accident but thank God all the parties are ok including the b**** as you put it.
Now if I'm reading correctly you said that she was coming out of a driveway or maybe her driveway, well let me tell you (and I'm with you on this) that if I'm not mistaking in some states if a person is coming out of a driveway a car car hits them, it is the responsibility of the on coming car to avoid the accident, yes believe it or not.
I hope everything work out for you and more important that the car get back to good driving condition so you can enjoy the benefits of owning a TL.

I did find the only applicable thing in my driver's handbook from when I took my test. "The law does not give the right of way to an driver, it only tells who should yield to it. Take as much care to avoid accidents as possible." Because the woman was given a "Failure to Yield Ticket," I think this is the most applicable. But because it cannot be proven, under any circumstances that I did not use all of my powers to avoid the accident, I did swerve and did slow, and was prepared to honk, I think I can handle this. Stupid insurance always short changing when it comes to paying out. Get the police report file number if you can. If should indicate who was at fault. If the report says that the stupid woman was at fault the insurance is hard press to say its your fault. F***ing moron.

I'm sorry about the accident hun and sorry that you have to deal with this BS from the insurance company, but at least you and everyone in your car are OK. I know it hurts seeing your baby like this, but remember, still, it is only a car. It could have been a LOT worse.

some people are just ****ing retarded. People cry and ***** about people driving too fast... Well i will hit 30 over on a daily basis, but i concentrate a lot when i go that fast .... while on the other hand these retards dont know how to drive at normal speeds and crash into us.

Allstate is horrible in paying out--and they never want to admit to responsibility if possible. I had to sue them (the woman that backed UP and hit me on a freeway on-ramp) for damages to my one week old TL-S! They kept saying I rear ended her--I did, because she was backing up!

Yes, DO NOT talk to her insurance company. Tell them to direct all inquiries about the accident to your insurance company. The lawyers will then duke it out. This happened to my mother, the other driver's insurance company called my mother asking her questions about the accident, wanting to know if she would sue, how much insurance she has. In the end, she was victorious, the other person's insuarnace company was attempting anything they could to try and not have to pay. Happens to everyone, its just representative of how litigous our society is. But that's another story...
