Accident - Who is at fault?
Not me, but my g/f was driving tonight and was coming up on a traffic signal. The light was red but turned green while she was approaching. There was a truck waiting at the light. I guess the truck stalled when the light turned green and by the time she realized the truck wasn't moving it was too late. She hit it. If the truck had no flashers on or anything, who is at fault. I kow she hit him, but is there something in the law that says you must put on your hazards or soemthing like that? This happened in santa barbara county, CA. Thanks.

Yep.... It is your fault.. Whenever you hit anyone from behind its automatically your fault. Did you call the cops. If possible don't report it to insurance. It will skyrocket.

i think... i am not sure about this, I mean, don't quote me or anything close to it, but like, yeah, yeah... no matter what, you are always at fault when rearending.

But then again, if you don't report it and your insurance carrier hears about it, you risk getting your policy cancelled.
And as for rear-ending someone and being at fault, that's not always the case. I'm sure most people here have heard of the "swoop and stop" trap that scam artists use. Usually, if we have an independant witness who saw the swoop and stop in action, the car that got rear-ended will be at fault. Also, if someone cuts you off and then slams on the brake, say in slow traffic, they're at fault too for making an unsafe lane change.

It is the driver's responsibility to check and make sure that the road in front is clear and safe before stepping on the gas. She is 100% at fault.

That happened to my friend last year. Only it was on I5 on the way down to LA from SJ. Some lady's car stalled and she left it in the middle of the highway. It was through the mountain part of the Grapevine. He ended up slamming his car into her and it ended up being his fault. Insurance said that he should have been more careful and seen that the car he was coming up on wasn't moving. sucks, but it's the truth.....

Like my insurance agent told me long ago, that in CA it is almost automatically your fault if...
You rear end someone,
You get hit during a left turn,
You get hit if you are going reverse.
Of course there will always be exceptions...but the burden of proof is on you.

Sorry to hear this, I hope she's OK. I agree w/everyone else. It will be her fault. A former co-worker of mine was in the same predicament, plus it was raining. Unfortunately, it's always the "rear-ender" who is at fault, not the "rear-endee".
