Accident. need advice

Accident. need advice

hey guys. i got in an accident tonight. front bumper is cracked and scratched. the guy who hit me is from ottawa, it was my fault for creeping out too far into the intersection to turn left, but im annoyed cuz he didnt swerve at all, just slammed brakes (speeding through yellow). so since he had right of way its my fault. so, this happened in toronto, hes from ottawa. we exchanged info (insurance licence etc) he wanted to call the cops than said forget it since it would take forever for them to come. so he went back to ottawa but took pics of my car before leaving. took pics after i moved it back a little :P. so basically what i want to know is, in ontario...do i HAVE to report this to police and or insurance? will any of his actions or decisions affect me since he left to ottawa? should i just ignore this guy now? as far as i know its no fault insurance in ontario, so if he chooses to make an insurance claim, his insurance pays for his car (97 mazda 626). should i report this? or just forget it? opinions would be greatly appreciated.

p.s. does any1 know a good but cheap place to fix/paint/replace my bumper in the toronto area?

it should affect you, depending on the damage and his, you can go under the table... pay for his damages and pay for your own as well.... might be cheaper but i don't know how your insurance works...

well I think since its your fault he should have went to the cops. and if he didnt do it right away then I dont know what he can claim after. he should have drove to the cop station right away, filled out a report, and they would have called you the next day to get your report. since he didnt do that but only took pictures, how will Ottawa cops do anything. he can go to his insurance but since you admited its your fault I dont see the need to report anything. even tho i think he should have done it cuz you have to report all accidents over 1000$ in combined damage or he cant go through the insurance

did he take any info from u? if he was smart he coulda reported it, what u could do is report it as a hit n run, to save urself....lol

When I had my first car and got in an accident (in Toronto) which was not my fault. I just took the guys info down and went to work (in Oakville), I thought hey I'll just go to the Oakville collision centre after work. Well when I got there they were like you need to go to the Toronto collision centre and report it, so I had to drive all the way to Toronto and make the report. So I dont know if the Ottawa centre will tell the guy the same thing, but in the GTA you have to report it to the closest centre to the accident even if its at a later time. So maybe he wont be able to report it unless he wants to drive all the way back here. But not sure what the insurance company would do in that situation.

For the repairs try this shop. Pal Auto 416-745-4865, they did body work on my integra and I'm planning on taking my TL there to for some touch up. He isnt the cheapest but he knows what he is doing.

I think the best way you should do is to contact him and see how he wants to resolve it. If he already has your phone number, then you just wait. If he reported his insurance, then your insurance will be contacted, and your insurance knows automatically you were at fault, which is normal.

some good info guys. first thing is, i never admitted fault to him... second thing is, if he has to come back to toronto to make a report (which needs to be done in 24 hours according to the mto website) and doesnt, than how is anyone supposed to determine fault? third, if he goes to his insurance without claiming a report and they notify my insurance, than how could my insurance just assume im at fault? im not making a claim for this. its just a crack in the bumper and some paint. the main point here is that i never admited fault to him, so even though i know in my head that im at fault. there was no cop present to determine who was at fault..... since damage is more than 1000 combined, am i legally obligated to report it to cops anyway?

acutee has the most solid and moral advice.

Don't try to ignore this if it was your fault, be a good citizen and just deal with it in a civil manner. If he took your information down (which he should have), then all you have to do is just wait for either your insurance company to contact you, or him. No worries on your end for now... and if you had insurance (like you should have), then let them do all the work.

Bottom line, if he has your information just sit back and relax. The first obligation is with him. He can choose whether to act or not, and if he approaches it in a civil and honest manner, then you should do so also.



And NO I'm not the other guy involved.
