Is this a Gearbox or other issue

I have a 2001 CL Type S with a auto box. I get a stutter in changing from 2nd to 3rd - but only sometimes. It's very abrupt as though something is kicking in and out rapidly. I can make it happen or not happen while driving. Here's how: it only happens when the Accelerator is at a certain position. If it's less than that or more than the position it normally happens at - I don't get the stutter. It only happens in D5. If I use D4 it never happens. Neither does it happen if I change gear manually. It's like a certain position on the Accelerator is the only place this happens. Gearbox oil is close to perfectly clear. Any ideas?

some more info

One I've had my CL since new in 2001 - I love it. Some guy at AAMCO drove it Friday and said it was like driving a Mercedes. About the stutter - it's been there since late 2005 or earely 2006. I know about the gearbox issues. I had the fix done to re-route the oil and they checked 2nd gear as soon as that came out. I'm looking for opinions not guru techno input - unless you have it. The techie know-how. That I can make the stutter go away puzzles me.

Are there any electronics, relays or switches etc, attached to the Accelerator inside the cabin or engine compartment?

Problem solved plus predicament

Okay issue solved: Dealer said around $ 4K to replace Gearbox. I told him it changes gears perfectly - no slipping in D4. So I drove D4 for a couple of weeks only allowing change up from 4th once at 60 MPH. Things started to improve. Did some research as I recall the CL 'learned when to change gears'. Figured want drives would need that fixed more than others. Researched Jaguars for sale and found that on all that provided a Carfax that the Jaga computer was reprogrammed once every 2-3 years. Took the CL to the dealer - mentioned this. And. The whole hesistation thing is gone after a 'service'. Even the steering mounted Vol control that used to change channels not volume - now works. Just the Torque converter whine is there. No slipping. No hesistation. In fact I have my car back as it first was in 2001 and this issue really started i 2005 which is the last record I have of going to the dealer until 1020. And the Predicament was: There's 116K miles on this gearbox and it still works perfectly. Any refurb box I get from Honda will have already failed - so I'm getting some bad for something good. Been driving with the radio off for a few months - that's when I notice the whine. Turned radio on and don't hear that anymore. So what was it: a software problem really. That could lead to a gearbox that won't change gears at all. There was more; flat spots, reluctance to change down etc. Now all gone.

Oh! The service cost a little less than the price to switch the gearbox out. Oh! Acura call it The Transmission on the CL. Service Manager assured me that it's not a Gearbox. Okay. Pointed to another SUV and said it's got a Gearbox not a Transmission. Said that because it's rear wheel drive. He said yes. Oops. It's not rear wheel drive. Told him the difference between his Transmission idea and a gearbox is the auto box has clutches inside along with the gears and a Torque converter to replace my foot. He agreed. Oh well. Okay.

wow are u serious, you have no more issues? How much did it actually cost to do the services and what exactly was done.?

You are describing the symptom I am having except I fear I won't be able to shift past 3rd. I hope to high hell that my car makes it to the dealership. The last time this happened it was my ECU......dammit all to hell with high mileage cars in general. Nature of the beast I suppose.
