Both are at fault.. Ramiel would be at fault for speeding and negligence for not looking before he was gonan pass the asshole up. The ASSHOLE in the beamer, if Ramile had hit him would probably be cited for something as changing lanes w/o seeing who's in the lane or coming down the lane is at fault. Check the local laws, here in CA the person doing the merging is at fault if an accident occured. Of course this case doens't apply as we have an agressive driving law which ramiel408 was violating.

doesnt really matter how fast the bimmer was going, if anything:

1. bimmer pulls into your lane going slower than you, (pulls directly in front of you) and you slam in to HIM, unless you had a whitness, or he truly admitted the guilt for cutting you off, then you are at fault for hitting him from BEHIND. he could make up any story because you hit him, basicallly. - but this isnt what happened.

THIS IS YOUR FAULT for traveling too fast! did you even push your brakes? i bet when you went to pass the bimmer, you continued driving fast, or even sped up to pass him a little better. i know from experience that braking would have been the best situation. even if you swerved into the other lane, by braking still, the car would have slowed down from 90-50 or less in just a quick moment. but you didnt want to slow down did you? you wanted to fly by the bimmer, and ended up doing the dumb thing by going into a slower lane of traffic and still speeding. REDUCE YOUR SPEED if you dont know what other cars are in the other lanes.

this whole incident is universally stupid. you should NOT change lanes when you dont know what is IN the other lanes. for all you know, (since you obviously didnt know) the traffic could have been stopped in that lane, and you would have slammed into the camry at 90 mhp, killing both YOU and the other lady. and if she had children in the car, then you would really learn something from this.

you better think about this incident more before you go buying another car, faster car, or whatever. you are probably going to drive like a fucking moron once again, but next time hit a car with children in it.

LEARN HOW TO DRIVE DEFENSIVELY......dont be a fucking idiot when behind the wheel. pay attention to what's around you. dont ASSUME that there isnt another car in the lane next to you

This is just a case of where parties involved need to be more careful about how they drive. Especially here in the bay area I've noticed that a good majority of drivers have a disregard for their surroundings and never tkae into account others around them.

speed has only a slight part in how you drive. i can drive 120 in my car and feel safe. i can drive on the twisties, and at autoX, and feel safe. why, because i know how to fucking drive.

he needs MORE experience, maybe schooling, defensive driving classes.

i sure hope you ALL learn something from this.

It don't matter how good of a driver you are.. shit like this can still happen. I happen to be a pretty good driver. My luck was that my right mirror was broken and pointing up into the sky. WHen the BMW cut me off I hit the brakes. I turned my head and didn't see the camry. My feet were on the brakes at all times... I didn't hit the gas at all. I even downshifted to 3rd while this was happening

I know how to drive very well, don't assume I don't and don't assume just because you think you can drive this kind of stuff can't happen to you.

If you are going 120 you are speeding... and way faster than anyone... something can happen and control the situation is much more difficult at that speed.

I take blaim that I was speeding, and if my mirror was ok this wouldn't have happend this bad. I would have probably hit the BMW

I'm sooo sorry to see that.. I know that stretch of 237, I used to drive there all the time.. There are just so many retarded drivers on the Bay Area roads..

Really now, whats with speeding in the left lane with a BROKEN right mirror on a highway that has traffic on your right? At 80mph you don't have enough time to safely check the right rear which is why you crunched the poor lady. You should have all of your weapons (working right side mirror...etc) if you must drive 80 on highways with other cars.

On a tangent would all of these CLS crackups have anything to do with insurance rates increasing on our model car?

It's not official... my adjuster told me today that my car is totalled!

a "total specialist" is to contact me now

so I got to find receipts for my RIMs and Tires

car has 33-34k miles on it

anyone have clues on what the worth of the car is or how I can find out?

Also... not sure how much I'll get paid back... my total cost for the car in 5/28/01 was $42,700~ that includes finance and tax et all... I put $10k down

whoa there... don't pay interest on money you are no longer borrowing. you need to find out from your bank or finance company what the pay off amount is on your car note. they'll roll any accrued interest up to that point into that amount and usually give you a 10 day window to pay the balance without incurring any additional interest charges.

here's a greatly simplified example:

say you borrow $10,000 for 5 years at 10%. the finance charge (interest) would be figured as if you borrowed $10,000 in year 1 ($1,000 interest), $8,000 in year 2 ($800), $6,000 in year 3 ($600), $4,000 in year 4 ($400), and $2,000 in year 5 ($200).

take the total amount of this interest (1000+800+600+400+200=$3,000) and add it to the amount you are borrowing for a total of payments over the term of the loan of $13,000.

your monthly payment in this example would be $217 (13000/60 months).

if you pay the loan off early, say after the 1st year, you'll have made $2600 in payments (217x12 months) of which $1000 would be the 1st year's interest. thus, you'll have reduced your outstanding loan balance by $1600 (2600-1000) to $8400 (10000 originally borrowed - 1600 principal reduction).

in this example your payoff would be about $8400, plus or minus a little bit of interest. this example was greatly simplified as they actually use amortization tables to determine the interest-to-principal ratio of your payments with early payments having a higher proportion of interest and later payments having less.

hopefully your car is worth more than the payoff amount (i.e., you aren't "upside down" on the loan) because you could be left holding the bag for the difference if you don't have gap insurance. the earlier you terminate a car note, the more likely you are to be upside down if you didn't make a healthy down payment.

Well as of Nov 11 I have $18,510.13 left on the car finance.

I'm sure the insurance will pay me out more than that amount, so I should be left with more in my pocket... not sure how much the car is worth exactly now... I hope atleast $30K? or upper 20's?

Thanks for all that info!!! The plan is to get my insurance to pay off my car then give me the remaining amount.

Did it look like the Engine mounts and block were damaged at all? I assume the passenger side mount is probably damaged. Doesn't look like the frame was pushed into the alternator and exhaust manifold nor the block though. I'd like to keep tabs on where your car goes if it is indeed totalled officially and the engine block is still good ...

Call me crazy, but totalling two cars in two years would not get you qualified as a "pretty good driver" no matter who you ask.

Onto a another subject. Yes sell the engine to SoCalV6. I know he wants so bad to have that J32. Vulture....

I'm pretty sure the engine is fine. After the accident I was able to drive it off the freeway. I looked inside and I'm pretty sure it got to the radiator... I think the furthest it may have got would be the alternator pulley. I'm sure the exhaust manifold is fine all the way through.

Well... the is in San Jose right now at a body shop and Farmer's Insurance is going to pay out the car. This comming Wednesday is when I'll get to talk to the 'total specialist'

don't look like they'll let me remove any parts... though I took out the navigation cd... it's ver 1.03... old... doubt anyone wants it :-(

I removed the emblems as memory pieces :-(... it's kind of really depressing right now... I mean I host this website on my server and pretty much live on it... and I no longer have my CL

I'm thinking instead of the WRX, I'm going to get this blue $500 1988 CRX 5spd with 143k on it. Good car to save money on and wait for the perfect car that I want.... not sure yet.

Wow, thanx for the response, didn't think you'd respond since vultures are pretty evil ya know. Well, as for taking parts out, that's too bad that you can't remove any parts, although with that Navigation CD, if it can be used by someone, you'd be surprised who might buy it over at Accordv6.com. I'm sure someone over there wouldn't mind a cheaply priced navi system, even if it's an older version, should still work for someone.

As for what you should do in regards to a car, my opinion might not be anything, but just take the time to look around and look through magazines on what may be coming out within the next year. You might find something that's on it's way out as something more enjoyable than what's out now. I think purchasing a daily driver beater CRX is probably a good idea until you can find out what you really want, perhaps a 6 spd CL-S, 5 spd IS300?? A 2002 WRX is a helluva choice in my opinion. The aftermarket is already embracing it tenfold and it's gonna get better n better, not to mention it already has extreme amounts of performance from the getgo. Provided that the CRX doesn't end up costing you boatloads of money on maintenance and tuneups, that's probably a good idea.

I don't think you'll honestly get over the loss of your ride until you find a new baby to cherish, and have new memories with, like the first time you give her a wash or the first time you take her to the local strip or movies or whatever. Till then, the pain will be there. And any genuine automobile enthusiast should be able to understand your pain right now. I don't know what I'd do if I crashed my baby, especially after all the money I've put into her .

Well I found out they would, but it is not advisable. Spoiler removed will leave holes in the hood lowering the value of the vehicle.

On Tuesday/Wednesday when I speak with the "Total Specialist" I will keep try to find out where the car will go for the vultures.

The S-03 tires have only 3k on them!!! brand new

SoCalV6... aka Vulture... the engine mounting seems all fine from what I saw... the alternator pulley I believe may be bent just a little (front passenger) -- not sure.

thanks for reminding me of the days I just got my CLS

02 WRX sport wagon 5spd is what I'm thinking but compared to the CLS ... it's not all that ... I did test drive it too. Just didn't feel right... miss my CLS too much. I want to wait untill the 6spd and see what all the car makers are up for.

OK... numbers are in

spoke to my 'total specialist' today.

my full coverage insurance will pay me:

$28,582.24 for my 01 3.2CL-S silver with navi and wing.

$1k for car rental
$210 for towing
not sure how much of my rims and tires will get paid back... I faxed them the recipts ... it won't be full... my S03's had like NOTHING on them... maybe 2-3k!

my next car... what do you guys think of this deal

1991 Honda Civic CRX Si, black, 5spd, A/C, sun roof, 93k, no accidents, two owners. 'average' condition I've been told. Going to go and see it tonight.

well I'll have 10-15k when this all is done in my pocket

$3500 for car, $2600 for insurance for a year, and I need the money to buy a house... gf don't care even suggested it so not like I need bling bling

and I miss stick... it could also be a humbling expereince and will get me to appretiate even more my next car.

this car also gets 37mpg... no interest in making it fast... but I can spend less than 10k and make it do 12-13 1320's.

The 91 CRX is the lightest one of 'em and it could be a fun project car.

My list of cars to have:
91 CRX Si 5spd
97 RX7 twin turbo
.. ??? my nice luxury car

don't want to waste an extra penny on half a nicer car since it would be wasted -- no plan to have this car for long. It'll also be perfect to teach my girl stick on ... then I'll give it to her or make it into a drag racing car in the future (on the track only... battleoftheimports.com )

CRX Si is one of the most fun to drive cars all around in my opinion.

actually i believe the 88 is the lightest CRX used to have one. 12.02@116mph

MY 90 ACCORD WAS TOTALLED OCT. 3RD THATS HOW I GOT MY CL-S, HIT BY A LOOSER W/ NO INSURANCE, LUCKILY I HAD UNINSURED MOTORIST PROTECTION. MADE $1200 OVER WHAT I PAID FOR IT SO IT TURNED OUT OK + GOT CL-S! SUB. WRX IS BADAZZ ,GUY I BOUGHT CL-S FROM IS THINKING ABOUT GETTING ONE, ALL THIS ISH HAPPENS 4 A REASON, JUST GOOD YOUR OK. LATE.

Hey man, glad to hear you're alright... cars can always be replaced, but you can't!

You mentioned that the car went out of control so you hit the brakes and held the wheel straight... that's the worse possible thing you could do because it takes all weight off the rear of the car, causing it to do whatever it wants. In a FWD car, if the tail gets loose, immediately get back ON the throttle and fight that skid with the steering wheel!

If you do get a WRX, make sure you take it autocrossing to learn how it handles beyond its limits. I've drifted & spun mine a few times, but the only things I hit were cones.

Interesting info on the crash part. At the speed I was going I had a large fear of flipping the car so I was trying to prevent that. I also had 0 space to play at the begining... since I was stuck in a postion where there is car on my left and right and front and back and trying not to get anyone to hit others as well. People eventually changed lanes and gave me space but by then I was already out of control and the car was spinning... once I was spinning I really don't know what the best action would be besides keeping the wheel straight since if I turn the wheel the car may flipp and I could die.... any crash experts here?

But I agree with you that when the spin is just starting to fight it... unfortunetly no space for me :-/

btw, I decided not to drop the $$$ on the WRX. I got a 91 CRX as a commuter car for now. Will wait till around March before I get another car... no idea about next car yet. I want something really nice... Q45? M5? I want something that can seat 5 people that I can take trips with... so I'll just stay patient and see what happens

12.02@116 is very impressive... where you running on a hybird? or stock engine ? If stock were you on any forced induction? running on slicks? nitro?

I'm getting some valve, piston, head, bore work done on the engine, pulley, intake. Already got DC MX catback and high flow cat... the header seems to be an aftermarket already and didn't see much gain on it yet.

I want to stay within the NA class so if I race it I could have a chance... didn't want to drop GSR in it ... don't want it brake on me.

it's my commuter car this second

so yeah... I'd love to hear from you on all the work you did on the car to get that time.

Ramiel,

So sorry about your crash...I have a 01 Satin Silver /w Navi & Spoiler too...just a sick feeling seeing your car with so much damage. Most important, though, I'm glad to hear you are alright.

I'm curious what the car is like when you lost control? Some cars are more maintainable than others. Did the VSA help/hurt the situation at all?

Sorry for the question, but I was just curious. Again, glad to hear you are alright...That's most important.

I also have a 01 Silver CLS and I will be more cautious about those stupid drivers from now on!!

glad that ur ok though I think that's the most important thing..

BTW u mentioned that ur thinking about a WRX, I would go with another CLS if I were u and if u do not want to spend the same amount of money buy it used, its still a CLS!
I sat in a WRX and it does not feel comfortable at all, yes it is powerful and fast and handles good but its not as comfortable as a CLS.. Just my 2 cents..

Glad to hear you're ok. Sorry about your car. It sucks that the BMW got away. F'n idiots who don't know how to drive cause accidents and get away. I'm sure the insurance will take it as a total. Buy a better car. Hope everything works out. Good Luck!

Really Important About Your Accident!











If you can check the seams of the car around the trunk, the hood and see if there are any gaps.. If you can even slightly stick your fingers into the gaps the your car is TOTALED! New Acuras have great front impact beams and where you gto hit in the front was the safest part... When in an accident you car crumples like a soda can of you step on it... But it pushes all the streamlines (doors, hood, trunk) out of wack... so if that is the case they should total it. About your rims, buy some cheap stupid 15-16" and put them on there then they will allow you to take your 18"s. Also see if there are any parts like the shifter, Cd changer, headrest, floormats any loose parts in the trunk that you can take and sell on e-bay... Hey evey $$$ helps! I totaled my TL so I know!
