Someone jacked my Car!

This guy stole a pic of my car and used it as a reference for some wheels he's selling.

I prefer seeing pictures of the actual item I am bidding on so that I can see what type of condition it's in. Who knows, maybe this guy has scratched up wheels but he's just using that picture to cover up the fact they're scratched?

i'd email him asking him to take it down. then email ebay about it. you should be able to set compensated for it. it's your copyrighted picture.

It is not copyrighted and if you deserve to paid for someone using your picture, it's probably about $1. Seriously, when you post a picture on the Internet, in a public place, how can you expect it to remain your property?

Clearly if you are misrepresented, that's one thing.

Actually I think it's ok to use someone picture as long as you don't intend to mislead someone else.

i remember reading somewhere that any picture you take is copyrighted. as for that guy's usage of somebody else's photo for an auction, that's a commercial usage, because he's using it for some sort of gain. if permission wasn't granted for the photo usage, then there is a case of some sort, however petty it is in this case.

I emailed the guy and he replied with a sincere, polite response. Therefor, I will have no problem allowing him to use my picture. I should have known he was a nice guy seeing as he's from Canada.

If you look closely at the photo, you can actually see the “Hosted by PhotoPoint” banner.
So it looks like he “jacked” that photo quite some time ago.

Funny side note:
On one of the Home Theater sites that I frequent, one guy noticed that his photos were getting a ton of hits from EBAY.
Somehow he tracked it and found out that someone had linked to photos of his audio equipment.
After polite E-Mails went ignored, he replaced the linked photo with a picture of a USED CONDOM.
The guy couldn’t change the link in his auction because he already had bids.
I forget how this ended, but I thought it was pretty funny.

Damn sorry to hear that, I think if I could remember Crazy Acura got the same incident too..... Some dude is claiming that he own's a pimped out TL-S it turns out that some of the photo was stolen from Crazy Acura's web page...

You might be right as long as that picture is creative. If you take a picture of the 7-11 and post it on the Internet, is it copyrighted? Meaning no one else can take and post a similar/identical picture? If you take a picture of your car in the 7-11 parking lot, is it copyrighted? If you are in the picture, is it creative? That's a good question.

Ultimately I think if the author insists that you stop using the exact file/photo that he took, perhaps you should. The Internet is complicated. You have copyrights, trademarks, and the ever so complicated plagiarism to deal with.

OMG that's hilarious! I have to admit I have linked to pictures for stuff I've sold before, but I've had my share of photos used as well.

Actuall it is coppyrighted. every photograph is considered unique and no matter where it is published or how it was taken the person who takes the pic owns it and all rights to use it. If anyone else wishes to use it then they must get permission. Also if the picture is taken of something that is nit public proberty or if the public domain a model release must be signed to allow a photo to be published, unless it is for use in the media for publications like newspapers which sole purpose is to tell the public information, i.e. ny times... so actually he stole the photo and is illeagly publishing a picture of your car. The one who takes the picture owns the picture no matter who owns the equipment, film, or the subject.

and oh yea, nice to hear that jsut a pic of your car was stolen and not the car
