i need ur help//sold my car but now he doesnt want it
i sold my car yesterday.. the guy came 3 times and test drove it and it was fine... that night he calls me and says the car smokes too much and i dont want it anymore.. I sold the car to him AS IS.. does he have the right to bring it back and get his money back.. or because i stated it was as is its his problem now
i knew the car had a little smoke but he was here 3 times and he should of noticed. The only problem is that i didnt tell him even though i knew.

you are a private seller and you sold it AS IS he should have known he was buying an AS IS car after all it is an older car
he has no recourse on you other that harrassing thr shit out of you
you sold it he bought it end of story...

as soon as he pulls off your drive way the car is 100% his. he has the car, you have the money. transaction completed. all sales final. tell him to get off your nuts. lol.

This is exactly why I have always utilzed some sort of contract when selling my previous cars to a private seller. As you stated before, after 3 test drives he should have noticed that problem already. An As-Is purchase is exactly that, As-Is, nothing more and nothing less. His mistake is that he didn't pay a mechaninc check the car out from top to bottom before purchasing it. So, It's your call if you want to refund his money but I don't think you are in any way obligated to as far as I know......

Yep sold AS IS, means final. When I sold my Accord, which was in perfect condition, but again USED the kid afterwards tried to say all of this stuff was wrong with it, first not true, cause I sold it in very good running condition, and he wanted me to pay half the costs, its like are you kidding me? I sold it in good faith, bottom line. I'd never sell something with problems, or keep anything. I babied that car for 9 years.

thanks for the feedback.. he had a mechanic come take a look.. now idk if he really was a mechanic cause he didnt even know how to chage light bulbs.. i had to do it for him.. anyways i think its his problem now..

he came back with the car. i felt bad cause i knew the car smoked a bit so i decided to give the money back.. sometimes im too nice but anyways i did a compression test and the rings were fine.. so looks like valves are leaking.. fixing the car this week and try again on selling it. i hope everything goes well this time

Got sued for the same thing years ago...and after FIRESTONE (lol) had looked at it for them. Went to court and made them look really stupid when it was all over. As is means as is. What pisses me off is that you gave the guy his money back? Thats what continues these dumb people not paying attention to what they are doing...you accomodate them! Dude leaned nothing whatsoever here...and you got screwed!

Actually, if he would have pursued it, he could have taken you to court and the sale would have been voided. Any sale of personal property over $500(which i'm assuming it was), must be in writing to be valid. Also, if he was a minor, he could have disaffirmed and goten his money back. Moral of the story: get a contract when selling your things.
