2003 Acura CL Type-S questions need answered!!!

Hey I'm 22 years old starting a new family money is extremely tight. I had a 98 neon that was over heating and everyone told me to scrap it and my mechanic said it was a bad head gasket but couldn't fix it because he was too busy now the car won't even start. So I bought a used 2003 acura cl type s from a used car dealer rode great during test drive and first few days. After I took it home and drove it very lightly I noticed small problems shifting witch quickly worsened. I contacted the dealer and he told me to bring it in. So I did and picked it up the next day. The mechanic there said he flushed the tranny twice and cleaned everything up. It rode great for two days then the problem started agin and agin worsened quickly and is a lot worse than it was before they flushed the tranny I've had the car almost three weeks it came with a warranty that is transferable the warranty is through WEC and includes transmission and drive axel it's been the weekend so I haven't been able to contact the dealer the lean holder or the company that provides the warranty yet. The rpms shoot up and the car will coast I let off the gas and it will shift... Sometimes. Sometimes the rpms will shoot up three or four times before it will shift. It does this in EVERY GEAR!! Driving the car has almost killed me already the 2days after the mechanic claimed it was fixed. I was told by several people afterwards you should never flush any tranny after 100k miles I'm at 133k. I'm supposed to bring the car back Wednesday for them to look at it. How do I fix this? I need to know so I don't get cheated on repairs that will only be temporary. I know the granny's for this model car were recalled in 2004 did they make a new tranny for the acura cl type s? I've heard an oil jet kit could be installed for cars with less than 15k miles and cars with over 15kmiles will have to have the tranny replaced and I assume the oil jet kit installed. Also I have seen one person talk about swapping his tranny with a tranny in an 06 odessey but I don't know weather or not that will work with my car it being a type s I assume his was just a regular auto tranny. I am honestly lost.... How do I fix my car? Can it be fixed? Have I bought a lemon?

FYI

Never flush a transmission. It will kill it ASAP.
