Your Legal Defense of Window Tint Tickets

PREVENTIVE DEFENSE - Rule 1: If you got a ticket for your tint being too dark, you were probably doing something you shouldn't have been doing in your car, somewhere you shouldn't have been after a certain time, or giving the law a reason to come knocking on your window. In general, cops hate the piddly-shit tickets, and hate going to court even more. DON'T GIVE THEM A REASON.


Your vehicle has factory tinted glass. (you can prove this with some material from Acura, maybe even in the owners manual).

Most state laws read that light meter test range is assuming the glass beneath is not tinted and are based as such; basically the law reads that no film applied may be beyond a certain restrictive limit. They can't prove the limit of the film while metering it through tinted glass. Devil is in the details and the presentation of your argument. Don't be an ass; be a lawyer (which are generally the same thing with different words being spoken).

The light meter results are then not able to be used against you, - but this only is a legitimate defense if the law in your state/county/city reads as such.

Know the law, then see if it's worth the fight. If the ticket is some piddly $40 or $50 and then go away - is it really worth your time?

i like to see someone win a tint ticket like this in socal..

almost impossible when the law states absolutely NO TINT

^Funny how every California UC vehicle I see on episodes of *COPS* has really dark tint...

They can dish it but they can't take it.

I'm so glad I don't get bothered about window tint where I live. I'd seriously move out of Oklahoma if I wasn't allowed to have tint. Had a rental car last year for 3 weeks, the left side of my face and my left arm were darker than the right side, it was wack.

Same story in Texas. My ex-girl came to visit me once after moving to TX and I was floored by the Limo tint on the side windows of her Civic.

In Ohio they state when it is used in conjunction with the tint that is already in the window so this wouldn't work here.

Here's the sections directly out of the law.

Any sunscreening material or other product or material applied to the side windows to the immediate right or left the driver, so long as such material, when used in conjunction with the safety glazing materials of such windows, has a light transmittance of not less than fifty per cent plus or minus three per cent and is not red or yellow in color.

says who? cops get OT pay for most court appearances, and receive commendations and sometimes $$ awards for tickets and/or traffic arrests

Hello, In the State of Delaware, (the 4th Most Miserable State to live in), the State does not allow any colored Tint on the Front Driver or Passenger side windows. However, the State will allow medical exemptions. A medical waiver is required. The paperwork is tightly controlled. The State DMV will contact the doctor and verify the exemption, and give the driver a copy of the paperwork. With the exception, you may tint the front windows, and be legal. If pulled over for illegal tint, just show the paperwork. Personally, I would not use tint below 35%, as limo tint is asking for trouble.

In Ontario, Canada, the law just states that the driver must be seen. So there's no law against it, perse, but there's no law that says you CAN have it. It's 100% up to the cop. So usually 35 is generally what ppl do (or 35 all round or 35 front only/20 in the back).

Im in Ontario too, the tint guy told me you can run 20% in the front and whatever you want on the back windows.... i have 5%, but i have seen people with 2% but thats too dark at night

^prob more lax up where you are, Toronto not so much. although, it's prob better in a "higher class" car, vs a civic.
there's technically no legal limit because it's "up to the officer". but i've never had any tint place tell me 20 at the front is ok.
i have a friend with 20 all round, and be ok, but their tint guy advised them not to actually lol

I just got a ticket 2 days ago in the province of Alberta. A cop came up beside me and pulled me over for nothing at all other than the tint.
It's a $57 ticket.
I couldn't care less about the ticket. I will not be removing any film from my windows. F@#k I'd just spent more than that on dinner and a starbucks for 4 people.
I've driven with tinted windows for 8 years and this is my first ticket.

^^^ What % tint do you have. Ya I don't blame you,I would do the same. I've never been told by the tint shop that 20% is okay in the front windows either. Anything less than 35% is taking a chance imo.

guys.. you cannot fight a fix it ticket..

there is a reason why its a fix it ticket.. you can only fight moving violations.

there is no way in court that you can prove to judge that you didnt have tint at that time..judge will always take law enforcement's words against civilians like us

I'm surprised the ticket was that low...I was told a few days ago by a guy that he got one for $180. I should look it up, since my tint is a ticket waiting to happen.

Also, you got off lucky...I've heard from a couple of guys that the cops will sometimes take a razor and allow you to remove the tint yourself on the spot. And Calgary, at this time of year, doesn't have the temperatures that will make that clean, but they're happy if you rip it up enough that you have to take it off.

The only thing that can happen is them reducing the ticket, when I went and fought mine I told them I had no idea tint were illegal and told the judge I had removed them. It was reduced from $120 to $70.

The tint place gave me four levels to choose from. 4 is limo and 1 is really light. So on my car I have 3 on the back three windows and 2 on the front 2 windows.

Yeah its just 57 dollars and as far as I can tell its not a fixit ticket.

The cop seemed really exasperated that my windows where dark.

I think most of you guys are missing the OP's point.

He is suggesting that some (most?) tint laws are written with respect to the transimission of the tint film itself.

Once the film is applied to a factory tinted window (most manufacturers glass is around 75% trasnmission) you can't determine the trasnmission of the FILM itself. If you can't determine the trasnmission of the film, you can't say if it is legal or illegal.


The OP's assertion may be true in some (or many) states, but it it's a subtle argument and whether it works or not would depend on 1.) a clear and careful understanding of the semantics of the law in your state and 2.) being able to present your agrument in a clear, logical fashion.

I pretty much gave up. I want to have darker tint and no front plate but more than that I don't want to get pulled over for knit picky BS. I have better things to do with my time. Even if I can fight a ticket and win it's just not worth my time.

Texas state law are nazi's about that sort of thing as I understand it. Friend of mine relocated to near Baylor, and they wouldnt let him register his santa-fe because it had cleared tails.

Yeah, my last ticket (yes ticket) was for not having my front plate. Needless to say I drilled holes in my bumper to mount it.

my friend in CA has been pulled over at least 3 times just for tint. I was in the car w/ him once, driving up the 5 from LA to SF, not speeding, not a fixed up banger or anything, just a regular 4runner w/ tint.

What's meant by "cleared tails"? Were the lights themselves altered to white, or was it simply the clear "euro-style" cover, with a red light inside? The latter should have been fine. The former would be just stupid.
