Transmission Settlement terms site

Law firm handling case gave me* link to this site. Asked that we refer to it first and see what questions remain.

I've only given it a once over, it sounds like pure crap. 109,000 miles or 93 months. As ones who have recieved the letter by mail of the settlement notice had posted.
Surely some mods and others can dissect this.

Time is of the essense, look at the opt out dates of Dec 11th.

*I'm just an Azine board member, i don't have any more answers then you do.

Q. I asked them: "To our knowledge, Honda never has fixed the faulty transmissions design. So in the event of a tranny failure, will Honda simply put the same "new" failed transmission in?"

Answer: "HONDA/ACURA PROVIDED EXTENSIVE EMPIRICAL DATA DEMONSTRATING THAT IT HAS SOLVED THE PROBLEMS WITH THE AUTOMATIC TRANSMISSION IN THE CLASS VEHICLES. AN INDEPENDENT MEDIATOR, WHO IS A RETIRED JUSTICE OF THE CALIFORNIA COURT OF APPEALS, MEDIATED OVER THE SETTLEMENT, INCLUDING HONDA/ACURA'S EFFORTS TO RESOLVE THE TRANSMISSION PROBLEMS, AND HE FOUND THE SETTLEMENT TO BE FAIR AND REASONABLE."

Websters defines empirical as: 1 : originating in or based on observation or experience <empirical data>

At least I hope they don't mean it as Websters #2:
relying on experience or observation alone often without due regard for system and theory <an empirical basis for the theory>

OK let me get this straight my car was bought on 3-31-02 and if you add 7 years to that it brings it out to 3-31-09. Now add 9 months to that and you get 12-31-09.yay I calculate that I drive 16K miles a year so in 3 years my car will have approximately 96K miles on it

2nd Q. I asked: To date, many Honda/Acura dealerships have been replacing the faulty transmission above current 100K warranty miles, such as 140K, knowing that it was Honda who initiated the faulty transmission. Known as a "goodwill" replacement.
If the proposed settlement of Dec 28th 2006 takes place, that being 109K or 93 month limits whichever comes first, will Honda insist that dealerships no longer perform goodwill replacements free of charge for cars over the settlement 109K-93 month warranty specs?

Answer: (English version: "Completely up to Honda.")
"AS COUNSEL FOR THE SETTLEMENT CLASS, WE CANNOT SPEAK FOR ANY FUTURE ACTIONS THAT HONDA MAY OR MAY NOT TAKE. HOW HONDA ELECTS TO TREAT MALFUNCTIONING TRANSMISSIONS OUTSIDE THE SCOPE OF THE CLASS MEMBERS IS SOLELY HONDA'S DISCRETON, AND WE CANNOT SPECULATE SA TO WHAT HONDA AND/OR ITS INDEPENDENT DEALERS WILL DO."

For those that say 9 months/9,000 miles is nothing, take it for whats it worth..most other companies just leave u out to dry. If you can mention to me an auto manufacturer that not only extended their powertrain warranty, but then re-extended it for a cars that have been out of production of about 3 years, or has even gone to any extent for this kind of customer care please let me know and that'll be my next purchase..but for now its Honda/Acura all the way.

If you fixed your transmission with your own money, you can get reimbersed by Honda/Acura.

The case things is that honda is/may extend warrenty to 93K miles and take no fault for anything.

The problem is a tranny problem will also wreck other parts of the car, esp motor mounts and cracked headers.

Thats Some Sh-- If you paid to have it fixed prior to Aug 21 2006 you get nothing. I say we all stand together and reject this settlement its garbage. They got me for 2 That I fully paid for. One at 65,000 and I was out of warranty and the second at 108,000 and I was out of the warranty again.

All that and we get nothing but these lawyers get paid.

I think your forgetting the about dangerous situations these "Faulty" transmissions put us in. Imagine just cruising on the pkwy at about 50 mph and your car just locks the front wheels without any warning! This is not compensation for me. When I had my maxima the tranny died and the car simply rolled to a stop. From what I seen anyway that is normal and no where near as much as a hazard. I could give you plenty of examples of cars with Trannies that go bad and dont put you in the same type of danger, especially under 100k (unless yours has seen some serious abuse). I will be selling this car but for now I have to deal with it. The only way Acura will satisfy me is by fixing the "Flaw"

Well then they need to fix the problem instead putting a bandade on it thinking it's going to heal.

The abuse doesn't matter, its more of a hit or miss situation with ure transmission. We own two TL's (01,03 -S) they both get beat on, yet the 03 had its tranny replaced at 45k, while the 01 is close to 130k problem free (knock on wood). Also, when the tranny begins to slip you can tell longggg before that jerking nonsense. There are always indications, and you have to be really not paying attention to not notice them, whether u can feel it slipping when accelerating or shifting hard. I dont know if you've had ure tranny go out on you, but you would understand what I mean when it happens, it's not something that happens overnight. Acura is doing more than enough to me.

Whoopee! Acura/Honda.
Everyone please read the letter, you are not getting 9months/9K miles for free. If you do not do anything and a settlement is reached, you will give up your right permanently to sue Honda for this tiny amount of benefit.
That is right, doing nothing means you agree to sell your right for this additional 9 months/9K mile warranty extension.
For those who are >109K miles, there is nothing lost by opt-out, just send a letter to the address provided in the letter.

Honda benefits from a settlement big time. The company is getting off huge potential warranty liability off its balance sheet from a faulty transmission design that is used for its high sales volumn models.
IMHO, law firms purposely ask for a small enough warranty extension so Honda has the incentitive to settle out of court. But big enough PR to smear Honda's reliability reputation.
A win for Honda, a win for lawyers, owners get a laughable benefit.

The entire “class action suite” is scam, IMHO.
It is going to cost Honda-Acura anywhere from $90 million to $180 million (different assessments). Whoever will still have car model that is listed in the suite will benefit by getting 9 months/9000 miles of additional warranty (BTW, very often Acura does offer additional help even after 100K miles), and lawyers will rake 9% of either $90 million or $180 million. Sweet deal for lawyers!
Please keep in mind that if this deal goes through, nobody will have Acura assistance after 9 months/9000 miles have expired. Do search in our forum and find how many people had their trannys replaced way after 100K miles at just labor cost. Quite few, as I recall. So, who is real beneficiary here?

Sounds good to me - and while we're at it - how about free maintenance for life as well?

OK - now the TL costs $64k...

There is no such thing as a lifetime warranty - unless you want to double or triple the price of the item.

What would be the normal lifespan of a transmission in a similar car. That should be the critiria for the extension in my opinion. I know at this point it doesnt matter, just a thought.
